NOTICE OF INTENT TO SOLE SOURCE: IAW FAR 5.101 this notice is to advise the public that The Department of Veterans Affairs Network Contracting Office 4, intends to award a sole source, Firm-Fixed-Price Contract to TCGRx Parta. Per FAR 8.405-6(a)(1)(B) VA requires a full service agreement on the TCGRX ATP (Automated Tablet Packaging) and Pearl devices, which are critical components in the pharmacy automation system. Proper maintenance and servicing of these devices are critical to ensure uninterrupted operation and compliance with healthcare standards. This requirement is for James E. Van Zandt VA Medical Center Altoona, PA for a base year with 4 option years, exercisable at the Government s discretion. THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE PROPOSALS or QUOTATIONS. Responsible sources may identify their interest by submitting capability information that clearly demonstrates the capability to perform the required work and licenses for Software. Capability information is required by 11:00 AM EST, Monday, December 30, 2024 to establish the ability of the source to meet this requirement. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. The Government will not be responsible for any costs associated with the preparation of responses to this notification. All inquiries and submittals must be sent via email to Angelamarie Scott, Contracting Officer, Angelamarie.scott@va.gov . Telephone inquiries will not be accepted. The TCGRX ATP and Pearl devices are proprietary systems developed and manufactured by TCGRX, using a third-party service provider would void existing warranties and compromise the devices operational integrity. Non-certified technicians lack the specialized knowledge to properly maintain or repair the devices, potentially leaded to errors in medication dispensing which could endanger patient safety and lead to non-compliance with healthcare regulations. Therefore, only the manufacturer can ensure the reliable and safe operation of the TCGRX ATP and Pearl Devices. STATEMENT OF WORK Statement of Work (SOW) for Comprehensive Full-Service Agreement for TCGRx 1. BACKGROUND: The James E. Van Zandt VA Medical Center (hereafter referred to as JEVZ VAMC , Altoona VAMC or the Government ) has a requirement for a full service agreement on the TCGRX ATP (Automated Tablet Packaging) and Pearl devices, which are critical components in the pharmacy automation system. Proper maintenance and servicing of these devices are critical to ensure uninterrupted operation and compliance with healthcare standards. 2. PLACE OF PERFORMANCE: The equipment is located int the main building, Pharmacy Department of the JEVZ VAMC Facility: James E. Van Zandt VA Medical Center 2907 Pleasant Valley Blvd Altoona, PA 16602 3. DESCRIPTION OF SERVICES: The contractor shall provide comprehensive maintenance services for the TCGRX ATP and Pearl devices on list and located in the pharmacy. Product Serial number ATP 22110614 LPU 22110614n LPU 22050331n Perl 15-3722-10367 Services include: - Preventive Maintenance (PM): Two scheduled inspections per year that include cleaning, calibration, and adjustments to ensure the devices operate within manufacturer specifications. - Corrective Maintenance (CM): On-site repair services, including the replacement of faulty hardware components, troubleshooting, and resolving any software issues. -Parts for PM and CM: replacement of non-consumable/durable parts included at no extra cost, to include all cost associated with shipping. -if non-consumable/durable part exchange required, shipping will be included for returns - Software Updates: Installation of all manufacturer-released software and firmware updates to ensure devices are running the latest versions. - On-Site Support: Rapid response to any unexpected device failures or malfunctions, with priority given to restoring operational functionality as quickly as possible. - Technical Support: Access to manufacturer-certified technical support for troubleshooting and resolving operational issues via phone and authorized and VA approved Remote Access Methods. 4. PERFORMANCE DELIVERABLES: - Maintenance Schedule: A comprehensive preventive maintenance schedule outlining the frequency and scope of maintenance activities. - Service Reports: Detailed reports of all maintenance and repair activities conducted, including parts replaced, issues identified, and corrective actions taken. - Software Update Documentation: Documentation confirming the installation of all software and firmware updates. - Maintenance Log: Record of all service requests, including response times, actions taken, and resolution outcomes. - Compliance Certification: Annual certification that all devices are maintained according to manufacturer specifications and are compliant with relevant healthcare regulations. - Services not covered under contract will not be conducted until such a time that a government-officiated purchase order is (if at all) issued for repairs, parts, or any additional work. 5. PERFORMANCE EXPECTATIONS: - Response Time: The contractor is expected to respond to service requests within 24 hours and be on-site within 48 hours to initiate repairs. Normal Hours of Operation - Monday through Friday, 8AM-4:30PM EST Repair Parts next day delivery / shipping included (for both received and returned) - Quality of Service: All services must be performed by manufacturer-certified technicians using only genuine TCGRX parts and tools. The contractor must ensure that all maintenance activities are conducted in a manner that minimizes disruption to pharmacy operations. - Communication: The contractor must provide regular updates to the Pharmacy Management and Health Technology Management on the status of the devices and any potential issues that could impact performance. - Compliance: The contractor is responsible for ensuring that all maintenance activities are in full compliance with VA policies, healthcare regulations, and manufacturer guidelines. 6. SECURITY REQUIREMENTS: Contractor will be required to check in with the VA Police each time they come on-site to perform contracted services or obtaining a VA Contractor ID badge from the VA Police to comply with physical security guidelines. Contractor will comply with all Security and Privacy requirements of the most current version of VA Handbook 6500.6 titled Contract Security. VHA Procurement Requester / Program Manager and VHA Contracting Officer will assure the Statement of Work and Performance of Work documents comply with VA Handbook 6500 for Security and Privacy. Contractor must always be escorted by VA staff, if not escorted the contractor must complete VA Privacy Training (TMS 20939). This training can be done on paper and filed in the Contract Folder. Contractor employee(s) must sign Appendix D Contractor Rules of Behavior. PO to determine if protected health information is disclosed or accessed and if a BAA is required. 7. RECORDS MANAGEMENT REQUIREMENTS: a. Contractor shall comply with all applicable records management laws and regulations, as well as National Archives and Records Administration (NARA) records policies, including but not limited to the Federal Records Act (44 U.S.C.� chs. 21, 29, 31, 33), NARA regulations at 36 CFR Chapter XII Subchapter B, and those policies associated with the safeguarding of records covered by the Privacy Act of 1974 (5 U.S.C. 552a). These policies include the preservation of all records, regardless of form or characteristics, mode of transmission, or state of completion.� b. In accordance with 36 CFR 1222.32, all data created for Government use and delivered to, or falling under the legal control of, the Government are Federal records subject to the provisions of 44 U.S.C. chapters 21, 29, 31, and 33, the Freedom of Information Act (FOIA) (5 U.S.C. 552), as amended, and the Privacy Act of 1974 (5 U.S.C. 552a), as amended and must be managed and scheduled for disposition only as permitted by statute or regulation.� c. In accordance with 36 CFR 1222.32, Contractor shall maintain all records created for Government use or created in the course of performing the contract and/or delivered to, or under the legal control of the Government and must be managed in accordance with Federal law. Electronic records and associated metadata must be accompanied by sufficient technical documentation to permit understanding and use of the records and data.� d. James E. Van Zandt and its contractors are responsible for preventing the alienation or unauthorized destruction of records, including all forms of mutilation. Records may not be removed from the legal custody of James E. Van Zandt or destroyed except for in accordance with the provisions of the agency records schedules and with the written concurrence of the Head of the Contracting Activity. Willful and unlawful destruction, damage or alienation of Federal records is subject to the fines and penalties imposed by 18 U.S.C. 2701. In the event of any unlawful or accidental removal, defacing, alteration, or destruction of records, Contractor must report to James E. Van Zandt. The agency must report promptly to NARA in accordance with 36 CFR 1230.� e. The Contractor shall immediately notify the appropriate Contracting Officer upon discovery of any inadvertent or unauthorized disclosures of information, data, documentary materials, records or equipment. Disclosure of non-public information is limited to authorized personnel with a need-to-know as described in the [contract vehicle]. The Contractor shall ensure that the appropriate personnel, administrative, technical, and physical safeguards are established to ensure the security and confidentiality of this information, data, documentary material, records and/or equipment is properly protected. The Contractor shall not remove material from Government facilities or systems, or facilities or systems operated or maintained on the Government s behalf, without the express written permission of the Head of the Contracting Activity. When information, data, documentary material, records and/or equipment is no longer required, it shall be returned to James E. Van Zandt control or the Contractor must hold it until otherwise directed. Items returned to the Government shall be hand carried, mailed, emailed, or securely electronically transmitted to the Contracting Officer or address prescribed in the [contract vehicle]. Destruction of records is EXPRESSLY PROHIBITED unless in accordance with Paragraph 7d.� f. The Contractor is required to obtain the Contracting Officer's approval prior to engaging in any contractual relationship (sub-contractor) in support of this contract requiring the disclosure of information, documentary material and/or records generated under, or relating to, contracts. The Contractor (and any sub-contractor) is required to abide by Government and James� E.Van� Zandt guidance for protecting sensitive, proprietary information, classified, and controlled unclassified information.� g. The Contractor shall only use Government IT equipment for purposes specifically tied to or authorized by the contract and in accordance with James E. Van Zandt policy.� h. The Contractor shall not create or maintain any records containing any non-public James E. Van Zandt information that are not specifically tied to or authorized by the contract.� i. The Contractor shall not retain, use, sell, or disseminate copies of any deliverable that contains information covered by the Privacy Act of 1974 or that which is generally protected from public disclosure by an exemption to the Freedom of Information Act.� j. The James E. Van Zandt owns the rights to all data and records produced as part of this contract. All deliverables under the contract are the property of the U.S. Government for which James E. Van Zandt shall have unlimited rights to use, dispose of, or disclose such data contained therein as it determines to be in the public interest. Any Contractor rights in the data or deliverables must be identified as required by FAR 52.227-11 through FAR 52.227-20.� k. Training. All Contractor employees assigned to this contract who create, work with, or otherwise handle records are required to take VHA-provided records management training, Talent Management System (TMS) Item #10176, Privacy and Information Security, Rules of Behavior. The Contractor is responsible for confirming training has been completed according to agency policies, including initial training and any annual or refresher training.� 8. PERIOD OF PERFORMANCE: One year from date of award with 4 option years.
