Description

Contractor is to provide Boulders of between 2 and 5 Tons which are for security reasons thus are required to be able to restrict vehicular movement. This is a solicitation for commercial items prepared in accordance with FAR Subpart 12.6. PLEASE READ T HIS ENTIRE NOTICE CAREFULLY AS IT CONSTITUTES THE ONLY NOTICE THAT WILL BE ISSUED. Solicitation number DAPC49-01-T-0067 is issued as a Request for Quotation (RFQ). The NAICS Code 327991, SIC Code 3281; small business standard is 500 employees. This acqu isition is full and open competition. The following clauses and provisions are incorporated and shall remain in full force in any resultant purchase order; FAR Part 52.212-1; Instructions to Offerors, Commercial Items is incorporated by reference. The pro vision at 52.212-2; Evaluation-Commercial Items, applies to the solicitation. Award will be made based on Fair and Reasonable Price. The government reserves the right to make award on the initial quote received without discussions. Each offeror shall in clude a completed copy of the provision at FAR 52.212-3; Offeror Representations and Certifications -- Commercial Items with its quote. FAR Part 52.212-4; Contract Terms and Conditions-Commercial Items, is incorporated by reference and applies to this acqu isition. Note the following addenda to FAR 52.212-4: Incorporate DFARS 252.204-7004; Required Central Contractor Registration. Incorporate the clause by reference at 52.212-5; Contract Terms and Conditions Required to Implement Statutes or Executive Order s -- Commercial Items. However, for paragraph (b) only the following clauses apply: 52.222-21; Prohibition of Segregated Facilities, 52.222-26; Equal Opportunity, 52.222-35; Affirmative Action for Disabled Veterans and Veterans of the Vietnam Era, 52.222-3 6; Affirmative Action for Handicapped Workers with Disabilities, 52.222-37; Employment Reports on Disabled Veterans and Veterans of the Vietnam Era, and 52.247-64; Preference for Privately Owned U.S. -- Flag Commercial Vessels. However, for paragraph (b) only the following clause applies: 252.225-7001, Buy American Act and Balance of Payments Program. The Contractor shall extend to the Government their standard warranty offered in similar types of sales. Acceptance of the warranty does not waive the Government s right with regard to the other terms and conditions of the contract. In the even t of a conflict, the terms and conditions of the contract shall take precedence over the warranty. The warranty period shall begin upon final acceptance of the items listed in the schedule. A firm-fixed price purchase order will be issued under the Simpli fied Acquisition Procedures.
