Description: The US Patent and Trademark Office intends to place a sole source order on July 6, 2001 for commercial services prepared in accordance with FAR ?12.6 Streamlined Procedures for Evaluation and Solicitation for Commercial Items as supplemented by the additional information included in this notice. This announcement incorporates all of the applicable provisions and clauses in effect through Federal Acquisition Circular 97-25 as if stated in full text, as well as the terms and conditions of FAR ?52.212-1, Instructions to Offerors for Commercial Items, FAR ?52.212-3, Offeror Representations and Certifications -- Commercial Items, FAR ?13.3 -- Simplified Acquisition Methods, and the Department of Commerce Agency Level Protest Procedures listed at http://www.uspto.gov/web/offices/ac/comp/. This solicitation deems acceptable only those services that meet the description of a commercial item as given in FAR ?2.101 Definitions. Objective: Using North American Industry Classification System Code 541990 ALL OTHER PROFESSIONAL, SCIENTIFIC, AND TECHNICAL SERVIES, the United States Patent & Trademark Office (USPTO) intends to place a sole source order with the National Academy of Public Administration (NAPA) to oversee a legislatively mandated study aimed at revising the current USPTO patent fee structure. NAPA will act as an independent ombudsman to provide assurance that an alternative fee structure is based on sound principles of public administration, supported by effective administrative systems, and accepted by the relevant stakeholders. NAPA is an independent, nonprofit organization chartered by Congress to identify emerging issues of governance and to help federal, state, and local governments improve their performance. The unique source of the Academy's expertise is its membership including more than 500 current and former Cabinet officers, members of Congress, governors, mayors, legislators, jurists, business executives, public managers, and scholars who are elected as Fellows because of their distinguished contribution to the field of public administration through scholarship, civic activism, or government service. Participation in the Academy's work is a requisite of membership, and the Fellows offer their experience and knowledge on a voluntary basis. Therefore, NAPA is in a unique position to provide the experienced, non-partisan expertise sought by PTO to oversee its alternative fee structure study. The prestige of the organization allows it to attract very senior individuals who have prior government service as appointed or elected public officials. A number of Fellows are quite familiar with USPTO issues and operations. NAPA has performed prior PTO assignments in a very satisfactory manner, and in doing so has gained considerable institutional knowledge of the PTO. NAPA has shown a clear ability to manage their assignments in a capable manner. NAPA is well qualified in terms of personnel, experience, and management capabilities. Most importantly for this assignment, NAPA occupies a unique position in the public administration area and is widely respected, both in and out of government.=20
