This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; QUOTES are being requested and a written solicitation WILL NOT be issued. This information is also available at the web site address listed at the end of this notice. Solicitation 98-SQ-30-12340 is issued as a request for quote (RFQ) and incorporates provisions and clauses in effect through Federal Acquisition Circular 97-04. The Bureau of Reclamation has a firm fixed price indefinite delivery, indefinite quantity requirement for advisory and assistance services to assist the Regional Director and his immediate staff on a wide variety of water issues. Quotes shall be provided for contract year 1 and option year 1 (contract year 2), option year 2 (contract year 3), option year 3 (contract year 4), and option year 4 (contract year 5). STATEMENT OF WORK: The purpose ofthis work is to provide services such as technical and policy advice and assistance to the Regional Director of the Lower Colorado Region of the Bureau of Reclamation and his immediate staff on a wide variety of water issues. The contractor will serve as the Regional Director's Counsel and technical expert on activities and issues under the purview of the Lower Colorado Region. These issues would include but not be limited to Colorado River Law, Indian Water Rights, Water Treaties with Mexico, Water Resources Management Policies and Criteria of the Department of the Interior, and water marketing transactions. The contractor will also be required to accompany the Regional Director and his immediate staff to meetings and to participate in discussions and negotiations pertaining to the activities and issues under the purview of the Regional Director. These meetings may be held with power users and water districts, state and local government officials, other federal agencies, tribal representatives, non-governmental organizations, and interested groups and individuals. The contractor shall furnish all supplies and equipment necessary to perform the services required. The Bureau of Reclamation's Lower Colorado Regional Office is involved in a wide variety of water management issues which requires Reclamation to continually be apprised of federal, state, and local regulations. This contract does not confer exclusive rights to the contractor to provide these services to the organization. The contractor shall have the following knowledge and skills: a) Be an expert on, and be experienced working with Colorado River Law. b) Be an expert on, and be experienced in working with federal, state, and local water issues for the states located within the Lower Colorado Region of the Bureau of Reclamation. c) Be an expert on, and be experienced working with Indian water rights. d) Have knowledge of, and be experienced with water marketing transactions. e) Have knowledge of, and be experienced with the water treaties between the United States and Mexico. f) Be able to draft various documents on water related issues from information obtained at meetings and from general research. The contractor will be required to perform the following duties: 1) Attend meetings with the Regional Director on water and power issues. 2) Evaluate and carefully consider statutory and regulatory requirements, agency management and structure, both federal and state public policy program goals and objectives, and public input on various water issues. 3) Prepare documents and research various water issues for meeting preparation and for the Regional Director. 4) Consult with the Regional Director on a regular basis to make recommendations and provide guidance on appropriate courses of action and means of resolution related to water and power issues associated with the Lower Colorado Region. It is anticipated that the consultant will be required to attend approximately one meeting a week which would be mainly held in either Nevada, California, Arizona, Colorado, or Washington D.C. and provide approximately 4 hours of consultation, research, or document preparation per week under item 2 below. The consultant shall be available to perform any of the above tasks within 24 hours of being notified. The contractor shall provide a quote for the following: Item 1: Attending meetings at any of the above mentioned locations for the daily rate of $__ __ __ __ __ __ ___. The contractor shall include in the daily rate above all costs for meeting preparation which may include research, consultations, conversations, and preparation time required for preparing for the meeting and all travel time both to and from the meeting location. Item 2: Consultations, research, and document preparation other than those included in Item 1 above, prepared at the request of the Regional Director or his immediate staff for the hourly rate of $__ _&llmdash;_. The following FAR provisions and clauses apply to this solicitation and are incorporated by reference: FAR 52.212-1 Instructions to Offerors -- Commercial Items; 52.212-2 Evaluation Commercial Items; 52.212-3 Offeror Representations and Certifications -- Commercial Items; 52.212-4 Contract Terms and Conditions -- Commercial Items; 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders -- Commercial Items; 52.217-9 Option to Extend the Term of the Contract. None of the additional clauses cited in 52.212-5(b) or (c) are applicable to this solicitation. In addition, FAR clause 52.232-33 Mandatory Information for Electronic Funds Transfer Payment and RAR (Reclamation Acquisition Regulation) clause WBR 1452.231-80 Contractor Reimbursable Travel Costs are also incorporated into this solicitation by reference. The contractor will be reimbursed for the costs of travel to each meeting location in accordance with, and not to exceed, the costs allowed by WBR 1452.231-80 CONTRACTOR REIMBURSABLE TRAVEL COSTS -- BUREAU OF RECLAMATION (SEP 1997). For FAR 52.212-2 Evaluation Commercial Items, the Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: 1. Knowledge of Colorado River Law, knowledge of Indian Water Rights, knowledge of federal, state and local water issues for states located in the Lower Colorado Region of the Bureau of Reclamation, knowledge of water marketing transactions, knowledge of water treaties with Mexico, and the ability to draft various documents on water related issues; 2. Price; and 3. Past performance. All three factors are of equal importance and each item within factor 1 are weighted equally. HOW TO RESPOND: In order to compete for this contract, interested parties must demonstrate that they are qualified to perform the workby providing by 3:00 P.M. PDT on May 27, 1998, a capability statement detailing: (1) your key personnel who will be providing the services and their expertise on their knowledge of Colorado River Law, Indian Water Rights, and knowledge of federal, state, and local water issues for states located in the Lower Colorado Region of the Bureau of Reclamation, knowledge of water marketing transactions, knowledge of water treaties with Mexico, and the ability to draft various documents on water related issues; (2) your quote for contract years 1 through 5; (3) specific references including project identifier/contract number and description, period of performance, dollar amount, client name and current telephone number for other work of this nature that your firm has completed within the past two years. Offerors shall include the information required in 52.212-1, Instructions to Offerors -- Commercial Items, and a completed copy of the provision at 52.212-3, Offeror Representations and Certifications -- Commercial Items, with their offer.
