Contracting Officer. USDA, Rural Economic & Community Development
(RECD) requires contractors to provide legal services for uncontested
and contested foreclosures and bankruptcy proceedings for 502 single
family properties located in the State of Florida. Services are to be
provided for RECD County Offices located in Leesburg and Ocala, and
covers the counties of Lake, Sumter, Hernando, Marion and Citrus. To be
eligible, the contractor must be a member of the Florida Bar and be
licensed to practice law in Florida State courts. The solicitation is
a total small business set-aside. The solicitation is advertised under
FAR Part 15, Negotiated Procedures, with the requirement for Technical
Proposals to be evaluated to establish technically acceptable offerors
whose price proposal will be considered for an award. The contract
award will cover a base year and two option years subject to
availability of funding after 9/30/95. Level of effort is based upon
foreclosure cases which is established as an estimated 25 cases for
base year and an estimated 20 cases each for option years one and two.
The Government's estimated dollar value is $100,000 to $150,000. All
responsible small business firms or individuals may submit a technical
proposal provided the pass/fail requirement can be met. No telephone
or FAX requests for solicitation packages will be accepted. Only
written requests for solicitation packages will be accepted. Electronic
transmission of proposals will not be accepted. Notice is given in
accordance with FAR 5.102, that 25 copies of the solicitation package
will be available for distribution on a ``first-come first-served''
basis. Evaluation factors and subfactors are as follows: I.
Understanding of Statement of Work (25 points) - (A) Approach to
handling contested and uncontested foreclosures. (B) Approach to
handling Chapter 7 Bankruptcy. (C) Approach to handling Chapter 13
Bankruptcy. (D) Approach for Representing RECD in Recovery of
Possession including Evictions. Minimum: Topical outline of Process.
Evaluation Factor is equal in consideration to price. II. Experience
and Past Performance for Legal Services incorporated into Statement of
Work (25 points). (A) Key Personnel identified with resumes. (B)
Experience with foreclosures, contested and uncontested filed in
Circuit Courts in Florida and with Bankruptcy. (C) References to
establish level and currency of experience. Minimum: Experience in
handling contested foreclosures. Evaluation Factor is equal in
consideration to price. III. Management Scheme (25 points). (A)
Resource Management. (B) Quality Control related to scheduling cases
and timely compliance with terms and conditions of contract. (C)
Methodology for Tracking and Reporting to avoid/eliminate delays that
result from lack of due diligence. Identifying and reporting challenges
to Federal Law. Minimum: Demonstrate Commitment ofResourcesand
Methodology to expedite completion of foreclosure within 6-month period
where lack of due diligence, alone, is not the basis for failure to
meet timetable. Evaluation Factor is considered greater than price. IV.
Past Performane for Legal Service contracts for RECD or for Similar
Commercial Contracts (25 points). Minimum For offerors with contracts
awarded within past 5-year period, list contracts, for those who have
not been awarded federal contracts, list a commercial source such as
lending institution for whom performane is documented. Evaluation
Factor is considered greater than price. Contemplated closing date is
