TITLE: D- NOTICE OF INTENT TO AWARD SOLE SOURCE SOL: 36C24220Q0088 DUE: 15 November 2019 at 10:00am EST SET ASIDE: N/A NAICS: 541519 POP START: 12/11/2019 AGENCY: Department of Veterans Affairs - Northport VAMC POC: Carlton Lunsford, email: carlton.lunsford@va.gov DESCRIPTION: NOTICE OF INTENT TO AWARD A SOLE SOURCE CONTRACT TO Government Marketing & Procurement LLC. Market research was conducted and determined that Government Marketing & Procurement LLC is the only vendor capable of providing the Vocera Smartphones PM service necessary that meet the requirements. All items are proprietary to Government Marketing & Procurement LLC and not able to be sourced out to another. This Notice of Intent is not a request for Proposals or Quotations. No solicitation document exists and no telephone or email inquiries will be accepted. No contract award will be made on the basis of proposals, or quotations received in response to this notice. The government MAY consider all Expressions of Interest (EOI) received prior to 15 November 2019. Please include your capability statement. Capabilities Statement should include: 1. Company name, address, point of contact, phone number, Dunn & Bradstreet number, and e-mail address; 2. Evidence of SDVOSB or VOSB status through registration at VIP (https://www.vip.vetbiz.gov/), if appropriate, 3. Evidence of ability to offer under NAICS Code 711510 and listing in the System for Award Management (www.SAM.gov), including a copy of the representations and certifications made in that system, 4.  A summary describing at least three (3) projects of similar size and scope completed in the past five (5) years that demonstrate your company s experience to satisfy the requirements of the SOW (3-page limit), 5. Photos of work related to the requirements of the SOW as appropriate. A determination by the government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. Responses to this notice must be emailed to carlton.lunsford@va.gov and received by 10:00AM EST on 15 November 2019. Submitters are responsible for ensuring their EOI reaches the designated contracting officer on-time. SCOPE OF WORK Project Scope This contract covers telephone support and software maintenance for the period of one contract year with the four options years thereafter. It does not cover on-site visits of the contractor for emergency repairs. The contractor will make remote diagnostic and corrective procedures to connect to the VOCERA System at the Northport VAMC campus. It does not cover on-site visits of the Contractor for emergency repairs The telephone support and software maintenance covers all critical & non-critical incidents. This telephone support may include remedial instruction on basic system usage, assistance with the performance of routine system procedures as described in the user documentation; assistance with the application of software patches, maintenance releases and upgrades; consultation of proposed workflow and system configuration changes, system and application performance tuning, system and application configuration, and changes to group configuration files. Definitions Acceptance Signature - COR or VA designee signature; indicates COR accepts work status as stated in SOW CO - Contracting Officer COR - Contracting Officer's Representative HCS Health Care System OI&T Office of Information and Technology RFP Request for Proposal SOW Scope of Work VA Department of Veterans Affairs VACO Department of Veterans Affairs Central Office VAMC Department of Veterans Affairs Medical Center VHA Veterans Health Administration VISN Veterans Integrated Service Network Specifications VOCERA Technical Support Responsibilities: Troubleshoot issues with the Vocera products, including performance within End User s Operating Environment after the issues have been validated by End User s Operational Support Resolve problems and research questions which cannot be answered through reference to Documentation, Support knowledge base and other support materials Inform End User of new releases and service packs, and advise on installation process Assist End User in troubleshooting Authorized Client Device connectivity issues and speech recognition issues, in conjunction with End User s wireless services resources. Assist in interpreting wireless traces and other diagnostic information captured by the End User Assist Northport Administrator when needed with configuring new and replacement devices, setting up new users/units, maintaining user profiles Provide warranty service for Vocera devices RESPONSE TIMES: Emergency: Client Devices has completely shut down, or is suffering such loss of critical functionality that an entire department or site is unable to utilize the Vocera Software, and no work- around is available Northport will report issue via telephone numbers provided by Vocera. Vocera will contact End User within 1 hour of receipt of notice of the Incident to collect information and to work with End User s Designated Support Contact to attempt to restore the functionality of End User s Vocera Software. Time Critical: Vocera Software is functioning inconsistently and with limited capabilities significantly impairing End User s usage and productivity, e.g. loss of certain administrative or reporting functions or Authorized Client Device features impacting multiple users, with no work-around available. Vocera will contact End User within 4 hours of receipt of notice of the Incident to collect information and to work with End User s Designated Support Contact to attempt to restore the functionality of End User s Vocera Software. Standard: Vocera Software are functioning inconsistently, and End User s usage and productivity are slightly impaired, but End User can reasonably work around such inconsistency or impairment. Severity 3 Incidents include issues with administrative or reporting functions, and other issues impacting individual users or Authorized Client Devices. Vocera will contact End User within 24 hours of receipt of notice of the Incident to collect information and to work with End User s Designated Support Contact to verify the problem. SOFTWARE SUPPORT: The vendor shall provide VA Hospital with software upgrades and updates as released. Updates shall include all modifications, corrections, and enhancements to software applications that the manufacturer makes available to its customers. Updates shall include mandatory updates mandated by the manufacturer or to comply with changes in federal or state laws and regulations. Dates of Service: Base year December 11, 2019 to December 11, 2020 Option years 1) December 11, 2020 to December 11, 2021 2) December 11, 2021 to December 11, 2022 3) December 11, 2022 to December 11, 2023 4) December 11, 2023 to December 11, 2024 Period of Performance: The contractor shall complete the work and provide all supplies as required under this SOW from date of award, as specified, unless otherwise directed by the Contracting Officer (CO) for a period of one year with (4) one year options to renew. Exercise of options is at the sole discretion of the government. Type of Contract: Fixed Price NATIONAL ARCHIVES and RECORDS ADMINISTRATION (NARA) RECORDS MANAGEMENT 1. Contractor shall comply with all applicable records management laws and regulations, as well as National Archives and Records Administration (NARA) records policies, including but not limited to the Federal Records Act (44 U.S.C. chs. 21, 29, 31, 33), NARA regulations at 36 CFR Chapter XII Subchapter B, and those policies associated with the safeguarding of records covered by the Privacy Act of 1974 (5 U.S.C. 552a). These policies include the preservation of all records, regardless of form or characteristics, mode of transmission, or state of completion.   2. In accordance with 36 CFR 1222.32, all data created for Government use and delivered to, or falling under the legal control of, the Government are Federal records subject to the provisions of 44 U.S.C. chapters 21, 29, 31, and 33, the Freedom of Information Act (FOIA) (5 U.S.C. 552), as amended, and the Privacy Act of 1974 (5 U.S.C. 552a), as amended and must be managed and scheduled for disposition only as permitted by statute or regulation.   3. In accordance with 36 CFR 1222.32, Contractor shall maintain all records created for Government use or created in the course of performing the contract and/or delivered to, or under the legal control of the Government and must be managed in accordance with Federal law. Electronic records and associated metadata must be accompanied by sufficient technical documentation to permit understanding and use of the records and data.   4. The Department of Veterans Affairs Northport Medical Center and its contractors are responsible for preventing the alienation or unauthorized destruction of records, including all forms of mutilation. Records may not be removed from the legal custody of The Department of Veterans Affairs Northport Medical Center or destroyed except for in accordance with the provisions of the agency records schedules and with the written concurrence of the Head of the Contracting Activity. Willful and unlawful destruction, damage or alienation of Federal records is subject to the fines and penalties imposed by 18 U.S.C. 2701. In the event of  any unlawful or accidental removal, defacing, alteration, or destruction of records, Contractor must report to [FACILITY]. The agency must report promptly to NARA in accordance with 36 CFR 1230. 5. The Contractor shall immediately notify the appropriate Contracting Officer upon discovery of any inadvertent or unauthorized disclosures of information, data, documentary materials, records or equipment. Disclosure of non-public information is limited to authorized personnel with a need-to-know as described in the [contract vehicle]. The Contractor shall ensure that the appropriate personnel, administrative, technical, and physical safeguards are established to ensure the security and confidentiality of this information, data, documentary material, records and/or equipment is properly protected. The Contractor shall not remove material from Government facilities or systems, or facilities or systems operated or maintained on the Government s behalf, without the express written permission of the Head of the Contracting Activity. When information, data, documentary material, records and/or equipment is no longer required, it shall be returned to The Department of Veterans Affairs Northport Medical Center control or the Contractor must hold it until otherwise directed. Items returned to the Government shall be hand carried, mailed, emailed, or securely electronically transmitted to the Contracting Officer or address prescribed in the [contract vehicle]. Destruction of records is EXPRESSLY PROHIBITED unless in accordance with Paragraph (4). 6. The Contractor is required to obtain the Contracting Officer's approval prior to engaging in any contractual relationship (sub-contractor) in support of this contract requiring the disclosure of information, documentary material and/or records generated under, or relating to, contracts. The Contractor (and any sub-contractor) is required to abide by Government and The Department of Veterans Affairs Northport Medical Center guidance for protecting sensitive, proprietary information, classified, and controlled unclassified information. 7. The Contractor shall only use Government IT equipment for purposes specifically tied to or authorized by the contract and in accordance with The Department of Veterans Affairs Northport Medical Center policy.   8. The Contractor shall not create or maintain any records containing any non-public The Department of Veterans Affairs Northport Medical Center information that are not specifically tied to or authorized by the contract.   9. The Contractor shall not retain, use, sell, or disseminate copies of any deliverable that contains information covered by the Privacy Act of 1974 or that which is generally protected from public disclosure by an exemption to the Freedom of Information Act.   10. The Department of Veterans Affairs Northport Medical Center owns the rights to all data and records produced as part of this contract. All deliverables under the contract are the property of the U.S. Government for which The Department of Veterans Affairs Northport Medical Center shall have unlimited rights to use, dispose of, or disclose such data contained therein as it determines to be in the public interest. Any Contractor rights in the data or deliverables must be identified as required by FAR 52.227-11 through FAR 52.227-20. 11. Training.  All Contractor employees assigned to this contract who create, work with, or otherwise handle records are required to take VHA-provided records management training. The Contractor is responsible for confirming training has been completed according to agency policies, including initial training and any annual or refresher training.   The VOCERA System is a communications systems. Data is not stored or recorded with the system.
