Description
This is a special notice prepared in accordance with Federal Acquisition Regulation (FAR) 5.2 "Synopses of Proposed Contract Actions" The USDA Farm Production and Conservation Business Center Operations Branch-Section 3-Nashville on behalf of USDA-Natural Resources Conservation Service intends to negotiate/award a sole-source firm-fixed contract with HDR Kleinfelder JV. The A-E shall perform all work necessary for construction bidding process support and engineering during construction for the following USDA-Natural Resources Conservation Service WRE Projects: Sunrise Sod, Highlands Ranch, Seventy Grove, and Russakis Ranch. The A-E will be required to furnish personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items necessary to perform and deliver data in connection with bid phase and engineering during construction support services for the construction of the Sunrise Sod, Highlands Ranch, Seventy Grove and Russakis Ranch Florida Wetland Restoration Projects. During the construction contract bidding process the A-E shall respond to bidder inquiries that require clarification of design intent. Amendments to drawings shall be made by issuing revised drawings. The A-E shall participate in two (2) site visits, during the construction phase, at the NRCS Project location with up to three personnel. The site visits will be at the discretion of the NRCS for the purpose of design construction approval. The A-E shall review, evaluate, and recommend adequacy of the construction contractor's submittals. The A-E shall respond to RFIs once the Government has determined a request should be deferred to the A-E. The statutory authority for this non-competitive acquisition is 41 United States Code 3304(a)(1) as implemented in Federal Acquisition Regulation 6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirements; this is a follow-on contract available only from the original source and it is likely that award to any other source would result in substantial duplication cost to the Government that would not be recovered through competition and would result in unacceptable delays in fulfilling the Government's requirements. The original design task orders were AG-2B46-D-16-0103 - Sunrise Sod, AG-2B46-D-16-0095-Highlands, AG-2B46-D-16-0009 - Russakis Ranch, AG-2B46-D-16-0010 - Seventy Grove for the design of wetland restoration plans and specifications. Because HDR Kleinfelder JV has already performed the designs for these projects using that architect engineer contractor's services for the bid phase support and engineering services during construction will avoid having to select another A-E for design, bid phase support and engineering services. The specifications and drawings are a proprietary design therefore another A-E Firm would not be familiar with the rationale of the design; not be able to accurately address Request for Information (RFI s); or accurately review construction submittal which are critical for proper construction of a sound end product. This will also avoid a duplication in cost of the previous design. If we were to compete this requirement to a different firm, the Government would require the incoming A-E firm to assume responsibility of interpreting the plans and specifications which might not result in the original A-E firm's intended outcome. Selection of another A-E for this contract would increase the Government's costs of obtaining the desired services, since other A-E firms would need to perform greater effort to evaluate and validate the existing HDR Kleinfelder JV design and prepare their input towards the bidder inquiries and issues that arise during construction. Moreover, selecting another A-E would result in a scenario with 2 different designers of record for inter-related projects. Using competitive selection procedures would be unacceptable because such a selection would take an estimated 4 months just to advertise, negotiate and award. By comparison, negotiation and execution of the work under the projected purchase order is expected to take less than 1 month, which results in an estimated savings in 3 months of administrative time for re-procurement and will allow the projects to meet current construction schedule requirements with minimum impact. A SOLICITATION WILL NOT BE POSTED. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS OR QUOTATIONS. All responsible sources may submit a capability statement, proposal, or quote to the contracting officer before the notice end date. If no affirmative written responses are received by 09:00 AM (Central Time) on September 6, 2019, an award will be made without further notice. Oral communications are not acceptable in response to this notice. A determination by the Government not to compete this proposed requirement is solely within the discretion of the Government.
