SPECIAL NOTICE: 36C24919Q0258 Description: NOTICE OF INTENT TO AWARD A SOLE SOURCE The Department of Veterans Affairs (VA), Network Contracting Office (NCO) 9, intends to issue a Firm Fixed Priced contract under the authority of FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements, on or about July 1, 2019 to THERAKOS. The period of performance will be for 1 year after award with 4 option years. The Tennessee Valley Healthcare System VAMC (TVHS VAMC) has a requirement for a Preventative Maintenance (PM) service contract on THERAKOS CELLEX Photopheresis System. Service to include but is not limited to: -Verifying that the proper fuses are in place -Lubricating the rubber seal at the bottom of the centrifuge bowl housing -Checking that the bowl lid switch is activated as the bowl lid is tightened -Calibration of the centrifuge bowl optics -Calibration check on the hemocrit detector -Recalibrating the thermocouples -Check that system operators are 100% of original equipment manufacturer (OEM) specifications -Replacement of any defective parts The contractor shall perform PM service to ensure that equipment listed in the schedule performs in accordance with the latest published edition of NFPA-99. NCO 9 intends to non-competitively award this requirement to Therakos, Inc since THERAKOS has proprietary authorization to perform maintenance on the THERAKOS CELLEX Photopheresis System. The warranty that is applicable to the THERAKOS CELLEX Photopheresis System states the following: Mallinckrodt Pharmaceuticals is the only manufacturer of the CELLEX Photopheresis System, and maintains all copyright, trademark and patent protections for its products to the fullest extent possible. Mallinckrodt Pharmaceuticals authorizes only THERAKOS trained and certified biomedical engineers to service or in any way alter or modify the CELLEX Photopheresis System As a result, any contractor other than THERAKOS that would be allowed to work on, maintain, and/or tamper with the current system in any capacity would void the warranty of the THERAKOS CELLEX Photopheresis System. Voidability of said warranty cannot be permitted. The North American Industry Classification System (NAICS) code for this requirement is 811219 with the size standard of $20.5 million. This notice of intent is not a request for proposals or quotes. However, all responsible sources may submit a technical capabilities/narrative that proves by clear and convincing evidence that the current warranty provided by THERAKOS, for the THERAKOS CELLEX Photopheresis System, will not be voided by having a contractor other than THERAKOS conduct the above referenced maintenance. If said technical capabilities/narrative is received within fifteen calendar days of publication of this notice, the narrative will be considered by NCO 9. All responses must be submitted to the Government point of contact at the email address shown below. A determination by the Government not to open the requirement to competition based upon the responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for determining whether to conduct a competitive procurement.
