Description
Out of Scope Modification The government intends to award an out of Scope Modification to Garney Federal Companies, Inc., Contract W912DW-16-C-0019 for the following Services: (1) Perform an investigative study and provide a conceptual design document with alternatives, and (2) Create a complete design plans and specifications package to repair the upstream entrance tunnel floor based on the Government's selected design. Modification will be issued under the following authority. Federal Acquisition Regulation 6.302-1 -- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. (a) Authority. (1) Citations: 10 U.S.C. 2304(c)(1) or 41 U.S.C. 3304(a)(1). Reason for Authority Cited: Background: The Mountain Dam 9-Foot Tunnel Rearmament project is on its second year of construction execution. Through the use of a Design-Build, Contract, Garney Federal Companies, Inc. and the A/E subcontractor Designer of Record (DOR) provided a unique design solution ensuring longer service life, dam safety early detection system to warn of failure during sediment passage, safer and faster construction conditions, lower construction costs, easier potential future maintenance, and reduced lifecycle costs. Justification: Adding the investigative study and design, to support repair of the tunnel floor at the upstream entrance, to the existing contract under Garney Federal Companies, Inc. as an out-of-scope modification is necessary due to substantial duplication of cost to the Government which would not be recovered through competition. Awarding a separate contract to perform an investigative study and design could result in a new A/E contractor voiding the current DOR's design warranty downstream of the subject area. Due to the DOR's value engineering granite block design proposal, the Government does not want to risk voiding the current DOR's design warranty. During the time of these services, the contractor will be on-site to completing other contract work. The current contract already has option items to perform tunnel closures and install and remove upstream entrance stoplog system which would need to be written into a new contract in support of an investigative study and design.
