DEPARTMENT OF VETERANS AFFAIRS NETWORK 22 LOGISTICS OFFICE JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION FAR 6.302-2, 41 U.S.C. 253 (a) (2) Team West Contracting; PR 9108-000063 1 Page 2 of 2 1. Agency and Contracting Activity Identification: The National Cemetery Administration ( NCA), Oakland Memorial Service Network Five, 1301 Clay Street, Suite 1230 North, Oakland CA 94612-5209, as directed by the NCA Riverside National Cemetery will enter into a Purchase Order that requires justification for other than full and open competition procedures. 2. Nature of Acquisition Being Approved: Riverside National Cemetery has an urgent need for refurbishing, service, and repair of the cemetery s water pump and filtration system. Award shall be made through other than full and open competition to Team West Contracting, due to the urgent and compelling need of the NCA Riverside National Cemetery. 3. Description of Requirement: The awarded contractor is to provide Water filtration and system refurbishing. The period of performance shall be from July 17, 2018 through May 31, 2018. The estimated cost is $36,000.00. 4. Statutory Authority Permitting Other Than Full and Open Competition: The Services are being procured under the authority of 41 U.S.C. 253 (a) (2), FAR Part 6.302-2(a). 5. The Nature of the Acquisition Requires Use of the Authority Cited: FAR Part 6.302-2(a) When the agency s need for the supplies or services is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals, full and open competition need not be provided. Market research indicates that there more than one companies that provide refurbishing of the water filtration services and repair. However, Team West contracting is the only contractor that can immediately provide the services limiting the risk of further damaging government property. If this emergency requirement is competed, this will prolong the needed repair service, which may significantly damage government property because of weather exposure. Based upon the reasons stated above, this requirement is urgent and compelling. Award shall be made to Team West Contracting for Refurbishing, Service, and repair of the cemetery s water filtration system. 6. A Description of Efforts Made to Ensure That Offers From as Many Potential Sources As Practicable and Whether a Notice Will Be Publicized. A notice shall be posted in accordance with FAR part 5 procedures. 7. Anticipated Cost: The anticipated cost should be fair and reasonable to the government based upon comparative service pricing from the Independent Government Cost estimate and the quote provided by Team West Contracting. 8. Results of Market Survey: Market research indicates that many companies are able to provide the service. However, immediate service is needed at this time to provide a one-time purchase order to repair the cemetery facility roof. 9. Any Other Facts Supporting the Use of Other Than Full and Open Competition: None. See Items 5 above. 10. Any Other Interested Sources? There are no other sources that have expressed an interest to date. 11. A Statement of the Actions, if any, the Agency May Take To Remove of Overcome Any Barriers to Competition Before Any Subsequent Acquisition is required: It is not anticipated that any subsequent requirement will be needed by the Government. 12.
