- The National Institute of Standards and Technology (NIST) intends to negotiate on a sole source basis, under the authority of FAR 13.501(a)- Special Documentation Requirements, with FEI Company, a part of Thermo Fisher Scientific located at 5350 NE Dawson Creek Drive, Hillsboro, OR 97124 to purchase routine preventive maintenance, emergency services, repair, calibration, and training for electron microscopes. The maintenance contract is required to keep these systems operational, with minimal interruption in service so they are available for use 24 hours per day and 7 days a week. This shall be 5-year contract, a base year plus 4 option years. NIST currently has a contract in place, contract number SB1341-13-CN-0042, which expires 4TH QTR 2018. The different operation units have decided that follow-on contracts will be pursued separately, therefore, only Material Measurement Laboratory's (MML) seven (7) Thermo Fisher/FEI electron microscopes will be included in this contract. NIST's Material Measurement Laboratory (MML) is one of two metrology laboratories within the National Institute of Standards and Technology (NIST). The laboratory supports the NIST Mission by serving as the national reference laboratory for measurements in the chemical, biological and material sciences. Activities range from fundamental and applied research on the composition, structure and properties of industrial, biological and environmental materials and processes, to the development and dissemination of tools including reference measurement procedures, certified reference materials, critically evaluated data, and best practice guides that help assure measurement quality. The sole source justification is based on the following: 1)Purchasing electron microscopes would result in duplication of cost and effort. Transitioning to new equipment would cause significant disruptions to MML's business processes including its ability to timely meet areas of national importance that are matched to include safety, security and forensics and research in materials measurements science. Transitioning to new equipment would cause unnecessary risks associated with advanced analytical methods and measurement capabilities for explosives and narcotics in supporting our forensic and homeland security programs. 2)Market research has shown that Thermo Fisher/FEI is the only authorized repair and maintenance service provider in the United States currently owned by NIST; therefore, Thermo Fisher/FEI is the only source available to provide the required maintenance agreement. The resulting purchase order will be a Firm Fixed Price purchase order. The NAICS Code is 811219 with a size standard of $20.5 Million No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, interested parties who regard themselves as capable of fulfilling these requirements are invited to submit responses to the Government for consideration. Responses received by 10:00 AM ET on Friday, July 30,2018, will be considered by the Government. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
