- The United States Department of Commerce (DOC), National Institute of Standards and Technology (NIST), Acquisition Management Division (AMD) intends to negotiate a firm fixed price purchase order, on a sole source basis, with EOS of North America, Inc. for metal powders: nickel alloy IN718 (110 kg), nickel alloy IN625 (30 kg), 17-4 PH steel (30 kg), and 15-5 steel (40 kg) for the Center for Nanoscale Technology Science and Technology (CNST) and Material Measurement Laboratory (MML). The statutory authority for this sole source acquisition is FAR 13.106-1(b) by the authority of FAR Part 13.5 Simplified Acquisition Procedures for Certain Commercial Items. MML Additive Manufacturing of Metals project, needs to build and study numerous additive manufactured test parts using NIST's primary additive manufacturing machine for metals, an M270 produced by EOS of North America, Inc. The primary feedstock materials for producing these parts are metal powders. Four different compositions are required in different amounts: nickel alloy IN718, nickel alloy IN625, 17-4 PH steel, and 15-5 steel. NIST has a service contract SB1341-17-SE-0270 with EOS of North America to perform preventative maintenance as well as any needed service to maintain acceptable performance of the M270 machine. This machine is intended to only process raw metal powders that are produced by EOS of North America, Inc. Using other powders from other suppliers in this machine would have an unknown and possibly detrimental effect on the machine's performance, would produce parts with potentially unknown properties, and would void the service contract. Only EOS of North America, Inc. can provide the metal powders to operate the M270 machine. Therefore, to continue using the M270 with the service contract only EOS of North America, Inc. comply with NIST's requirements for metal powders. Delivery shall be FOB DESTINATION and shall occur not later than 30 days after receipt of order. The North American Industry Classification System (NAICS) code for this acquisition is 332117, and the size standard is 500 employees. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, all responsible sources interested may identify their interest and capability to respond to this requirement. The Government will consider responses received by established due date/time set forth in this notice. Inquiries will only be accepted via email to joni.laster@nist.gov. No telephone requests will be honored. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for determining whether to conduct a competitive procurement in the future.
