Description
Limited Sources - J&A-Amazon Web Services This Limted Sources J&A is posted to as part of an agreement complete the resolution of a GAO protest of the contract award, 19AQMM18F0737. Justification and Approval for Limited Source Acquisition under FAR 8.405-6 1.This Limited Source Justification is issued to replace and supersede the Justification for a brand name only purchase of Amazon Web Services published in support of FedBid Buy # 907697_02 issued February 7, 2018 and limited to GSA Schedule Bid only. The Justification published in the FedBid Buy was incorrect as a matter of law for two reasons: 1) it was prepared as an Exception to Fair Opportunity under FAR 16.505(b) rather than as a Limited Sources Justification under FAR 8.405-6; and 2) it relied upon inappropriate and overstated general claims about the superiority of Amazon Web Services to other commercial cloud-based services. Nevertheless, the Department does have a current limited need for Amazon Web Services to support a limited number of existing cloud-based databases for a limited period while longer-term requirements are identified and acquired. 2.The near-term requirement is to purchase Amazon Simple Storage Service (Amazon S3), Amazon Elastic Compute Cloud (Amazon EC2), Amazon CloudCheckr and Amazon Elastic Block Store (Amazon EBS), to continue to support a limited number of unclassified databases, including (1) Eforms.state.com; (2) archival sites for the Department of State website; and (3) Usaseanconnect.gov. 3.Award was made under FedBid Buy # 907697_02 to A & T Systems of Order No. 19AQMM18F0737 issued under Contract GS-35F-247DA at a price of $592,510.89 for the necessary suite of Amazon Web Services. The Government's estimate for these requirements was $600,000. 4.This acquisition should have been conducted under authority of FAR 8.405-6(a)(1)((i)(A). An urgent and compelling need exists and following competitive procedures would result in an unacceptable delay. 5.The contracting officer has determined that the order represents the best value consistent with FAR 8.404(d). 6.The Department shall conduct market research into cloud-based services in accordance with the Federal Acquisition Regulation (FAR). The Department intends to pursue an acquisition strategy that will be open to commercial cloud service offerors authorized to the information impact level required for specific Department systems and information. To promote competition, the Department intends to clearly define its cloud requirements and conduct future cloud competition on a "best value" basis such that costs of migration from Amazon Web Services may be considered as an evaluation factor but not cited to justify a sole-source award or limit competition. 7.The Department intends to modify Order No. 19AQMM18F0737 as follows: a.to establish an award price of $592,510.89; b.to limit the period of performance to one year from the date of modification plus an extension of up to six (6) months under the authority of the "Option to Extend Services" clause, FAR 52.217-8, if a short-term extension of services is necessary; c.to limit the cloud services that may be provided under the Order to Amazon Simple Storage Service (Amazon S3), Amazon Elastic Compute Cloud (Amazon EC2), Amazon CloudCheckr and Amazon Elastic Block Store (Amazon EBS); d.to limit the databases supported by cloud services acquired under the Order to those databases supported at the time the Order was awarded; and e.to impose and not exceed a cumulative ceiling of $200,000 on all modifications increasing the price of the Order during the period of performance, and to impose a proportional limitation during any extension period. 8.The Department will not add additional databases or cloud services to the Order on a non-competitive basis. 9.The Department intends to issue a "sources sought notice" or take other action in advance of future unclassified cloud service requirements to inform potential bidders of the Department's requirements and to allow bidders to submit a statement of capability for review and consideration by the Department. 10.I certify that the information in this justification is accurate and complete to the best of my knowledge and belief.
