Description
THIS IS A SOURCES SOUGHT FOR MARKET RESEARCH PURPOSES ONLY. The Department of Veterans Affairs is in the process of determining the acquisition strategy for ATTORNEY Services for VA Las Vegas Nevada Health Care System. Please note that this Request for Information (RFI) is for information only and does not constitute a solicitation for competitive bids/proposals and is not to be construed as a commitment by the Government. However, all interested parties who believe they can meet the requirement are invited to submit information describing their capability to provide the required services. OVERVIEW: Guardianship Service will place emphasis on difficult to place patients who require the services of a guardian. Guardianship Services require the use of an Attorney. The Attorney shall pursue all legal relief under Nevada Revised Statute Chapter 159 Guardianship. It is understood that Attorney will use the services of a qualified investigator to assist in meeting Client s direction. All investigators shall be court-appointed and provide reports with specific recommendations as part of their services. SEE STATEMENT OF WORK ON PAGES 2-3 FOR MORE INFORMATION. Organizations responding to this RFI should provide the company s capabilities to perform this requirement. The NAICS code is 541110. The Small Business size standard is $11 million. The information received as a result of this notice will be considered solely for the purpose of determining whether to conduct a competitive procurement. A determination by the VA not to open the requirement to open competition, based on responses to this sources sought synopsis is solely within the discretion of the VA. The Government does not intend to pay for any information provided under this sources sought synopsis. All responses must be sent via e-mail to Rico Johnson, Contracting Officer, at rico.johnson@va.gov. Responses to this sources sought synopsis are due by 12:00 PST on March 14, 2018. Statement of Work (SOW) Veterans Health Administration (VHA) Guardianship Services 1. SCOPE. This document defines the effort required to provide Guardianship Services to the VA Southern Nevada Healthcare System. Background. Guardianship Service will place emphasis on difficult to place patients who require the services of a guardian. Guardianship Services require the use of an Attorney. The Attorney shall pursue all legal relief under Nevada Revised Statute Chapter 159 Guardianship. It is understood that Attorney will use the services of a qualified investigator to assist in meeting Client s direction. All investigators shall be court-appointed and provide reports with specific recommendations as part of their services. Specific Requirement. An authorized Attorney will provide legal services and furnish legal advice regarding guardianship matters in the following manner: To discover and analyze financial information, as requested by the VASNHS, for the purpose of determining qualification and/or eligibility of Federal or state benefits of specific Veterans; As requested by VASNHS, determine if a lesser-restrictive placement option may be appropriate for a Veteran. If necessary, to obtain a court order appointing guardian. Attorney shall pursue all legal relief under Nevada Revised Statute Chapter 159 Guardianship. It is understood that Attorney will use the services of a qualified investigator to assist in meeting Client s direction. All investigators shall be court-appointed and provide reports with specific recommendations as part of their services. 1.3. Excluded Requirements. Contracting agents for the VHA will award additional/separate contracts for: None 2. APPLICABLE DOCUMENTS. None. 3. REQUIREMENTS. Fees shall include but are not limited to a) court appearances; b) telephone calls and/or conference to and from the Client; c) office conferences; d) legal research; e) dispositions; f) review of file materials and documents sent or received; g) travel time; h) waiting time; i) preparation for trials; j) hearings and court conferences; and k) drafting of pleadings, correspondence and office memoranda. There is a minimum time charge of 5 minutes for time as to any item billed. Attorney shall agree that the total of all charges for any single matter will not exceed the agreed upon amount, inclusive of fees and disbursements. Disbursements. Subject to above, VSNHS agrees to pay all out-of-pocket disbursements and expenses incurred by the Attorney in connection with the client s matter subject. These disbursements include, but not limited to: a) filing fees; b) service of process costs; c) witness fees; d)travel and related costs; e) special research services. The attorney agrees to obtain the Client s approval prior to incurring any single disbursement/expense valued at more than $250.00. Terms and Condition of Payment. Attorney agrees to secure a Purchase Order from VA Sierra Nevada Healthcare System before the incurring fees and/or costs pertaining to any legal matter referred by the Client. Attorney fees and costs to be paid at the conclusion of a matter referred to Attorney upon the presentation that 1) the Veteran/proposed ward does not have adequate funds to cover fees/costs and 20 court approval of Attorney s statement of fees and costs. Cooperation. Client agrees to corporate fully with the attorney in all matters during the term of this agreement, including providing the attorney all relevant information necessary to pursue the work described above subject to federal law governing the release of individually identifiable and protected healthcare information. Confidentiality. The attorney agrees to hold all communications and information provide to him by the Client in total confidence, except as authorized and directed by the Client. While the attorney will, upon the Client s direction, communicate with third parties known to the client, it is the Client, not the third parties, who is the attorney s client. The Client authorizes the attorney to communicate with the following people concerning this matter. Outcome. The Client understands that the Attorney cannot and doses not promise or guarantee any specific result or outcome in this matter. The contractor will not require connection to any VA internal network. The C&A requirements do not apply, and that a Security Accreditation Package is not required:
