Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation and a separate written solicitation will not be issued. This solicitation number is NICHD-18-022 and is issued as a Request for Quotation (RFQ). The solicitation/contract will include all applicable provisions and clauses in effect through Federal Acquisition Circular 2005-97. The North American Industry Classification (NAICS) Code is 811219 and the business size standard is $20.5M. However, this solicitation is not set aside for small business. This acquisition is being conducted using Simplified Acquisition Procedures in accordance with FAR Part 13. Eunice Kennedy Shriver National Institute of Child Health and Human Development (NICHD) intends to contract on a sole source basis with FEI Company, 5350 NE Dawson Creek Drive, Hillsboro, OR 97124-5793 to procure a one year (Period of Performance dates 3/6/18 - 3/5/19) Preferred Service/Maintenance Agreement for the following instrument: FEI's Tecnai20 TEM Electron Microscope - SN: D2067 - Quantity (1) ea. FEI service contracts offer complete lifecycle support for optimum system performance. Typically, FEI's standard service contracts include: Planned maintenance, Onsite service visits, 24/7 service operations (in many geographic areas), Access to FEI technical support, Account management and Global logistics Services to include but not limited to: •Labor hours including travel time and expenses, parts coverage (including all accessories listed on contract •Replacement field emission gun tip, replacement parts and components to manufacturer's specifications. •RAPID remote diagnostics (Remote Access Program for Interactive Diagnostics) is a service program to boost up-time and reduce time to repair by providing support through a secure desktop sharing session. RAPID connects microscope users directly to FEI's service engineers, application specialists and factory experts, enabling them to: Solve problems remotely, often without requiring a service visit, remotely diagnose and correct system issues and order parts prior to an on-site service visit,engage factory experts for instant 2nd and 3rd line support to your local field service engineer and enhance operator effectiveness through real-time observation •Consumable coverage •Software coverage/updates: software updates that improve the functionality of previous software capabilities •Service availability: Monday through Friday, during FEI's normal business hours (8:00am - 5:00pm) •48 hour targeted labor response time •Scheduled Maintenance: Preventative maintenance visits for ordinary repairs and adjustments and unscheduled maintenance •Discount on Additional Service and parts •Equipment Coverage for specific base tool and FEI components, any additional accessories, third party items from vendors Edax, Gatan, Oxford and Bruker. •Service requests to be called in by customer, FEI will make commercially reasonable efforts to respond w/in set time frame, if not resolved in reasonable time frame, FEI will escalate the problem/issue by providing both telephone and or on-site support as necessary •Telephone Support provided during the set business hours to include operating practices and service issues diagnosable/resolved over the phone •Replacement parts and components FEI will ship standard parts and/or components w/in 24 hours after authorization for a part and/or component, etc. FEI Company is the only authorized (repair and maintenance) service provider for the Tecnai20 Electron Microscope, a sole source product, manufactured exclusively by Fei. Due to the highly specialized technical expertise required for the services, there are no subcontracting possibilities offered or such repair and maintenance service. Engineers providing maintenance and repair services for the Tecnai are company personnel specifically trained in the manufacture installation and maintenance of the Tecnai. The Tecnai20 is a fully computerized system controlled by unique software and is an extremely advanced, computer-controlled instrument combining mechanical (high vacuum, sample position control), electron optical (lenses) and computer components. To achieve the required image resolution and reliability, highly specialized training and access to both specific parts and computer software is necessary. FEI is the only source for most the parts necessary for repairs. The service contract provides service (including parts and software upgrades), preventive maintenance and timely response by NIH-campus based engineers to the address problems of any scope. The Tecnai 20 electron optics working in different modes, high voltage, vacuum, pneumatic and mechanical subsystems are all highly specialized and thus can only be serviced by technicians specifically trained by the manufacturer. The Tecnai 20 is mission critical for the scientific experiments undertaken in the individual laboratory where this device is maintained in NICHD laboratory. Thus, timely service is crucial in the functioning of the Tecnai 20, getting timely service engineer dispatched is critical to the scientific experiments in the laboratory. Slow or non-prioritized service dispatch can lead to down time on the Tecnai and scientific experiments delay and/or other compromises to experiments. The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under authority of the 41 U.S.C. 253(c) (1), FAR 6.302. This notice of intent is not a request for competitive quotations however, all responses received, within fifteen calendar days from the date of publication of this synopsis will be considered by the Government. The offeror must include a completed copy of the provision of FAR Clause 52.212-3, Offeror Representations and Certifications - Commercial Items with its offer. The provisions of FAR Clause 52.212-1 Instructions to Offerors - Commercial Items; FAR Clause 52.212-2, Evaluation - Commercial Items; evaluation factors (1) technical capability to provide all services/consumables, etc. outline above (2) price; and (3) past performance. Technical and past performance, when combined, are significantly more important than cost or price; FAR Clause 52.212-4, Contract Terms and Conditions - Commercial Items; and FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items - Deviation for Simplified Acquisitions applies to this acquisition. The offeror must include their Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. Offers must also be accompanied by descriptive literature, warranties and other information that demonstrates that the offer meets all of the foregoing requirements. Quotations will be due ten calendar days from the publication date of this synopsis or by February 21, 2018 by 10 am EST. via email or postal mail or other mailing services. The quotation must reference "Solicitation number" NICHD-18-022. All responsible sources may submit a quotation, which if timely received, shall be considered by the agency.
