- This NOTICE OF INTENT TO AWARD A NON-COMPETITIVE CONTRACT is in accordance with Federal Acquisition Regulations (FAR) 12-Acquisition of Commercial Items and FAR 13-Simplified Acquisition Procedures. The authority for this award is FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements ; utilizing citation 41 U.S.C. 3304(a)(1). This requirement is for CASI, Inc. JES2FTP software license and annual maintenance. LaBayne and Associates, Inc. doing business as CASI Software is the developer of the CASI JES2FTP software. The requirement is for license and annual maintenance of JES2FTP and RPL software on two servers. The Office of Personnel Management (OPM) intends to issue a Request for Quote (RFQ) for a non-competitive award that will result in the issuance of a contract to the incumbent contractor, LaBayne and Associates, Inc., DBA CASI Software, 10231 Slater Ave, Ste 117, Fountain Valley, CA 92708-4752, not later than March 15, 2018. This contract will have a period of performance of three (3) years (a base period of 1-year and three 1-year option periods.) The primary North American Industry Classification System (NAICS) Code for this requirement is 511210-Software Publisher and the Small Business Size Standard is $38.5 Million. THE PURPOSE OF THIS NOTICE IS TO SATISFY THE REQUIREMENTS OF FAR SUBPART 5.2. THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. However, all responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency, within 14 calendar days from the date of this notice. Submissions must be submitted, in writing, via email to the contract specialist Mr. William Dunlap at william.dunlap@opm.gov and copy the Contracting Officer Ms. Jessica Guadalupe at jessicas.guadalupe@opm.gov. Submissions after that date will not be considered. No solicitation will be issued. Interested parties wishing to submit their questions, interest, and capabilities must do so in writing via email. Verification of receipt of electronic transmission is the sole responsibility of the contractor. A determination not to compete this action based upon responses received is at the sole discretion of the Government. System for Award Management (SAM) is required prior to execution of award. If no other viable competitive responses are received, it is Government's intention to issue an award to LaBayne and Associates, Inc., DBA CASI Software.
