Description
Notice of Intent The Office of Acquisition and Agreement Management (OAAM), of the National Institute of Standards and Technology (NIST), on behalf of the NIST Laboratories, intends to negotiate on a sole-source basis with Tenzi of Fovaros, HUNGARY, under the authority of FAR Part 13.106-1(b), as implemented by the Federal Acquisition Regulation (FAR) Part 13 for the procurement of three identical tristimulus colorimeters. The Acquisition Management Division (AMD) at NIST intends to procure the required tristimulus colorimeters under a Firm Fixed Price Purchase Order using Simplified Acquisition Procedures for Commercial Items (FAR Parts 12 and 13). The NIST Physical Measurement Laboratory (PML) has a need for three identical tristimulus colorimeters for an existing custom tristimulus colorimeter system to realize the NIST detector-based color scale and the required spectral responsivity match to the CIE standard color matching functions. This supports calibration services and will be applied at the US Navy for the same applications. Only Tenzi tristimulus colorimeters are 100 percent compatible with respect to the current tristimulus colorimeters system. To develop proper functionality, the new tristimulus colorimeters are required and need to be compatible with the existing tristimulus colorimeter, which use proprietary information. During previous fabrications of NIST developed devices TENZI made the fabrication-level design after the NIST made preliminary design. The fabrication design is the proprietary of TENZI; the meter standards were fabricated by TENZI, calibrated by NIST, and applied by the U.S. Military (Air Force and Army). For functionality and compatibility requirements, and to ensure the detector-based color scale and the required spectral responsivity match to the CIE standard color matching functions are not compromised, the new tristimulus colorimeters must be obtained from Tenzi. Only Tenzi has the unique capabilities of providing the identical types of tristimulus colorimeters as required to ensure full compatibility and functionality for detector-based color scale and the required spectral responsivity match to the CIE standard color matching functions. Tenzi is the sole source provider for the required system and is the only vendor able to provide the tristimulus colorimeters that meet the Government's minimum requirements which makes them uniquely qualified. The North American Industry Classification System (NAICS) code for this acquisition 334516, with a size standard of 1,000 employees. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. Interested parties that believe they could satisfy the requirements listed above for NIST may clearly and unambiguously identify their capability to do so in writing on or before the response date for this notice. No solicitation package will be issued. This notice of intent is not a request for competitive quotations. However, responses received by December 28, 2017 at 11 am Eastern Standard Time (EST) will be considered by the Government.
