National Cemetery Administration Pacific District 1301 Clay Street, Suite 1230 North Oakland, CA 94612-5209 JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION FAR 6.302-1, 41 U.S.C. 3304 (a) (1) San Francisco Public Utilities Commission PR 8985-000009 Agency and Contracting Activity Identification: The National Cemetery Administration (NCA), Pacific District, 1301 Clay Street, Suite 1230 North, Oakland CA 94612-5209, as directed by the NCA Golden Gate National Cemetery will enter into an agreement that requires justification for other than full and open competition procedures. Nature of Acquisition Being Approved: Golden Gate National Cemetery yearly water services. Award shall be made through other than full and open competition to the San Francisco Public Utilities Commission who is the local government body and the sole water service provider for the area. Description of Requirement: The awarded contractor is to provide Water services. The period of performance shall be from October 01, 2017 through September 30, 2018. The estimated cost is $600,000.00. Statutory Authority Permitting Other Than Full and Open Competition: The Services are being procured under the authority of: (X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; The Nature of the Acquisition Requires Use of the Authority Cited: FAR Part 6.302-1(a) When the agency s need for the supplies or services can be provided by only one source. Market research indicates that there more than one company that provides water services. However, the San Francisco Public Utilities Commission is an affilliate of the City and County of San Mateo and San Francisco and is the only authorized provider for water in the area in which the Golden Gate National Cemetery resides. There are no other known water providers that can perform the same services for the Golden Gate National Cemetery. A Description of Efforts Made to Ensure That Offers From as Many Potential Sources As Practicable and Whether a Notice Will Be Publicized. A notice shall be posted in accordance with FAR part 5 procedures. Page 1 of 2 Anticipated Cost: The anticipated cost should be fair and reasonable to the government based upon comparative service pricing from past awarded agreements. Results of Market Survey: Market research indicates that many companies are able to provide the service. However, water services are typically operated by one company or local government and responsible for a certain area. Any Other Facts Supporting the Use of Other Than Full and Open Competition: None. See Items 5 above. Any Other Interested Sources? There are no other sources that have expressed an interest to date. A Statement of the Actions, if any, the Agency May Take To Remove of Overcome Any Barriers to Competition Before Any Subsequent Acquisition is required: It is not anticipated that any subsequent requirement will be needed by the Government.
