- RFQ Form (SF 1449) with Terms and Conditions U.S. Customs and Border Protection has a procurement request for 820 Grams of pharmaceutical grade Fentanyl Citrate (Powder Form) in bulk (single package, not dosage). This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The solicitation number is 70B06C18Q00000004 and is issued as a Request for Quotes (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-95. In accordance with Federal Acquisition Regulations (FAR) Clause 52.219-6 this requirement is being solicited as a total set aside for small business. The associated North American Industrial Classification System (NAICS) code for this procurement is 325412 with a small business size standard of 1,250 employees. This requirement is a total Small Business set-aside and only qualified offerors may submit quotes. The proposed contract action is for 820 Grams of pharmaceutical grade Fentanyl Citrate (Powder Form) in bulk (single package, not dosage). Order is to be delivered to the CBP Springfield Laboratory, in Springfield, VA 20598 (Full Address to be given to the awarded Contractor). Shipping must be free on board (FOB) destination CONUS (Continental U.S.), which means that the seller must deliver the goods on its conveyance at the destination specified by the buyer, and the seller is responsible for the cost of shipping and risk of loss prior to actual delivery at the specified destination. Delivery shall be made within 14 days after receipt of order. All perspective offerors shall be properly licensed and monitored according to Local, State, and Federal Regulations, including, but not limited to, the Food and Drug Administration (FDA) and Drug Enforcement Agency (DEA). Delivery must incorporate sufficient high-density material or other packaging as well as any required labeling to comply with applicable Federal and or State standards relating to shipment of a controlled substance of that which is being procured. The selected offeror must comply with the following commercial item terms and conditions, which are incorporated herein by reference and apply to this acquisition: FAR 52.212-1, Instructions to Offerors - Commercial Items; FAR 52.212-3, Offeror Representations and Certifications - Commercial Items - the selected offeror must submit a completed copy of the listed representations and certifications; FAR 52.212-4, Contract Terms and Conditions - Commercial Items; FAR 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders-Commercial Items, paragraph (a) and the following clauses in paragraph (b): 52.219-6, 52.222-3, 52.222-19, 52.222-21, 52.222-26, 52.222-35, 52.222-36, 52.222-37, 52.222-40, 52.222-50, 52.223-18, and 52.225-1. The full text of the referenced FAR clauses may be accessed electronically at https://www.acquisition.gov/far/. Along with these noted provisions and clauses, all additional provisions and clauses in the attached RFQ Document (SF 1449) apply to this acquisition. Only emailed quotes received directly from the offeror shall be considered acceptable. Quotes are due no later than Monday October 16, 2017 5:00 PM Eastern Standard Time.
