- The Office of the Comptroller of the Currency, hereby gives notice of their intent to award a contract to EMS Software dba Dean Evans & Associates, Inc., 6465 Greenwood Plaza Boulevard, Suite 600, Centennial, CO 80111, on a sole source basis utilizing FAR 13, Simplified Acquisition, procedures in accordance with 41 USC 253(c)(1) as implemented by FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements. The Office of the Comptroller has a requirement to procure EMS Enterprise Annual Software Maintenance. EMS Software is the sole source provider of the software maintenance. The Dean Evans Associates wrote the code for the Event Management System (EMS) software and it is their proprietary software. Only Dean Evans has access to the software code in order to be provide patches, updates and trouble-shoot issues with the EMS software. Dean Evans' Event Management System (EMS) is the only one with the Application Program Interface (API) to the Tandberg Management System (TMS) Video Teleconference System that is used by the OCC which interfaces with EMS to allow for the scheduling of video teleconference (VTC) units in conference rooms. Maintenance for the EMS as well as for the room wizard and VTC scheduling modules can only be provided for by Dean Evans & Assoc., and it is for these reasons that the OCC intends to award a sole source contract to this vendor. This is not a request for competitive proposals; however, all proposals received in writing within three days after date of publication of this notice will be considered by the Government. Responses must be supported with clear and convincing evidence to clearly be able to provide the services outlined in this notice. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government.
