Description
U.S. General Services Administration GSA Region 7 Leasing Division Justification for Other than Full and Open Competition Lease Number: GS-07P -LLA00129 Project Number: 6LA0278 Agency Name : DHS-ICE -OPLA •1. Identification and Description of Action Being Approved: The General Services Administration received a requirement from the Department of Homeland Security's U.S. Immigration and Customs Enforcement's Office of the Principal Legal Advisor (or DHS-ICE-OPLA) for 345 rentable square feet (RSF) of office type space at 365 Canal Street, New Orleans, LA in order to house a satellite office under the new lease number GS-07P-LLA00129. The Department of Justice's Executive Office for Immigration Review (or DOJ-EIRO) is currently in the same location DHS-ICE-OPLA has requested space. By locating DHS-ICE-OPLA and DOJ-EIOR in the same building, the Government will ensure the efficient mission delivery of carrying out DHS-ICE-OPLA's statutory requirement to appear in court on a daily basis. Approval is requested to negotiate a new lease with the lessor at 365 Canal Street, New Orleans, LA without full and open competition on behalf of DHS-ICE-OPLA per their provided mission critical reason. •2. Description of Supplies or Services Required: DHS-ICE-OPLA submitted their requirements on May 23, 2017 for 531 rentable square feet of office type space. To satisfy the DHS-ICE-OPLA's mission requirements, the facility must be located in 365 Canal Street, New Orleans, LA The proposed action is to procure a 10 year term lease for 531 rentable square feet of office type space for DHS-ICE-OPLA under the new lease number GSA-07P-LLA00129. The 10 year term lease is set to commence on February 8, 2018. The estimated annual cost of this new lease from Years 1-5 is $$13,502.78. The estimated annual cost of this new lease from years 6-10 is $14,033.78 The delineated area for this lease is North: Iberville Street, East: N Claiborne Avenue, South: Pontchartrain Expy (US 90), West: Mississippi River. •3. Identification of Statutory Authority: 41 U.S.C. 253(c) (1): Only one responsible source and no other supplies or services will satisfy agency requirements •4. Demonstration that the Anticipated Cost will be Fair and Reasonable: In accordance with Federal Acquisition Regulation (FAR) 6.303-2(a) (7), the Contracting Officer determines by certifying this document that the anticipated cost to the Government of $17.65/RSF for the entire requirement is fair and reasonable. Recent market data findings and research conducted by GSA in New Orleans, LA showed the rental rate within the delineated area ranges from $15.00 - $60.00 per RSF. •5. Description of the Market Survey Conducted: On September 22, 2016, GSA conducted a market survey that identified the following four locations including the incumbent that could meet the agency's requirements: Market Data for the Area Address Asking Full Service Rental Rate a. 356 Canal Street $18 - 19.50 b. 1010 Common Street $15 - $25 c. 935 Gravier Street $15 - $60 d. 601 Poydras Street $19 - $20 •6. Other Facts Supporting the use of Other Than Full and Open Competition: The lessor located at 365 Canal Street, New Orleans, LA is responsive. The Lessor confirmed there is available space in the 365 Canal Street location that could meet the agency's requirements. •7. Statement of Actions to Overcome Barriers to Competition: Not Applicable. •8. CONTRACTING OFFICER CERTIFICATION By signature on this Justification for Other than Full and Open Competition, the Lease Contracting Officer certifies that the award of a new lease of 531 RSF is in the Government's best interest and that this Justification is accurate and complete to the best of my knowledge and belief. •9. TECHNICAL REQUIREMENTS PERSONNEL CERTIFICATION I certify that by signature on this Justification for Other than Full and Open Competition, the supporting data used to form the basis of this Justification is accurate and complete to the best of my knowle dge and belief. FAR Part 6.303 requires that information on which the Justification is based be certified as complete and accurate by the technical or requirements personnel. FAR Part 6.304 specifies that the justification must be approved in writing by a specified designee (position title from FAR used above) based on TCV. No additional guidance is included in GSAM Part 506.3. *Regional practice requires concurrence by the Leasing Director and Legal Counsel where TCV>$700,000, by the RC where TCV>$13.5M and by all lower level approvers.
