Chapter VI: Other Than Full and Open Competition (OFOC) SOP Attachment 3: Request for Sole Source Justification Format >$150K OFOC SOP Revision 05 Page 3 of 3 Original Date: 03/22/11 Revision 05 Date: 05/02/2016 DEPARTMENT OF VETERANS AFFAIRS Justification and Approval (J&A) For Other Than Full and Open Competition (>$150K) Acquisition Plan Action ID: VA250-17-Q-0595 Contracting Activity: Department of Veterans Affairs, VISN/NCO 10, Columbus VA Ambulatory Care Center is responsible for the proposed contracting action using Purchase Request # 541-17-2-250-0287. Nature and/or Description of the Action Being Processed: The Louis Stokes Cleveland VAMC Otolaryngology is requesting additional Endoscopies. The size of the new/requested endoscopy equipment needs to be compatible with current market standards for in-office endoscopy, which necessitates the addition of new camera boxes/modules. This action will be awarded as a Firm Fixed Price new contract. Description of Supplies/Services Required to Meet the Agency s Needs: As a one-time purchase the following items, quantities and cost are as follows: Wade Park ENT outpatient clinic is requesting additional endoscopies. The current endoscopes are too large to access various parts of the sinus and nasal cavities. This requirement will allow office endoscopic examinations for all diagnostic nasals and sinus anatomy and any disorders related to the nose/sinus. This will include any and all postoperative monitoring, procedures and debridement. The equipment will also be utilized for in-office ear Otologic diagnostic exams and procedures. The estimated delivery time will be 30 days ARO. Statutory Authority Permitting Other than Full and Open Competition: ( X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; Demonstration that the Contractor s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Karl Storz has a reputable history and has emerged as one of the market leaders in Sino Nasal and Endoscopic equipment. Karl Storz and their exclusive small Business Distributor, L1 Enterprises, are currently the only vendors that are capable of providing office Endoscopes with the technical specifications described in Section 3 above. Additionally, the existing Endoscopic Tower in our clinic is of the Karl Storz brand; to be fully compatible and maintain continued and regular use of this tower, Karl Storz equipment is required. Otherwise the Veteran s Health Administration would experience substantial duplication of cost that could not be expected to be recovered through competition and unacceptable delays in fulfilling this requirement. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Market research was conducted by searching VetBiz, GSA Advantage, GSA eLibrary and Google. Research was also completed by online catalog reviews. Karl Storz is the manufacturer of this requirement and L1 Enterprises is the exclusive authorized Distributor of this requirement. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: This is the best value option since it allows the facility to continue using all other equipment associated with this requirement. The Contracting Officer has ensured that the offered cost is consistent with the Independent Government Cost Estimate. In addition L1 Enterprises is offering the requirement for 10% less than Karl Storz. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: The market research conducted included a review of product catalogs, FSS and GSA. Product research determined that there were no vendors that could supply the above mentioned Scopes that could meet the government s needs Any Other Facts Supporting the Use of Other than Full and Open Competition: n/a Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: Both Karl Storz and L1 Enterprises expressed interest in providing this requirement. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: At this time, no barriers can be removed for this requirement, but the program office will continue to evaluate and monitor the market availability of other sources which may be compatible and exchangeable with the currently owned Endoscopic Tower.
