This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. The solicitation number is: VA259-17-Q-0336, and it is issued as a request for quotation (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-89 issued and effective July 14, 2016. This solicitation is set-aside for Small Business. NAICS: 511210. Date and place of delivery (FOB Destination): Delivery shall be within 15 days ARO. Oklahoma City VAMC 921 N.E. 13th Street Oklahoma City, OK 73104 The provision at 52.212-1, Instructions to Offerors Commercial, applies to this acquisition. The provision at 52.212-2, Evaluation Commercial Items, does not apply to this acquisition. Offers will be evaluated LPTA. Offerors are advised to include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications Commercial Items, with the offer. Contracting Activity: Department of Veterans Affairs, VISN 16, Oklahoma City VA Medical Center J&A for other than full and open competition for maintenance services on ProVation GI software. 2. Nature and/or Description of the Action Being Processed: Full Service Contract for Annual Preventive Maintenance and repair services for ProVation Software at the Oklahoma City VA Health Care System. Estimated Value: REDACTED Description of Supplies/Services Required to Meet the A gency s Needs : Veterans Affairs requires a contractor to provide software license, updates, and support for ProVation GI software at the Oklahoma VA Health Care System. Services are to be performed in accordance with this PWS and to OEM standards, with the intent of ensuring the equipment operates as the original manufacturer intended, uninterrupted (95% uptime), with the latest updates, in a cost-effective, efficient manner, contributing to the VA Mission. 3. Demonstr ation that the C ontr ac tor s Unique Qualificati ons or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; this is Critical Care Medical equipment the System utilizes OEM proprietary software. The software is the intellectual proprietary property of Wolters Kluwer and only ProVation can license and maintain the software, as well as provide remote support and required updates. 5. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Wolters Kluwer was contacted to determine authorized distributors. They responded that ProVation is the only company allowed to provide maintenance to the ProVation GI software. 6. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The established price schedules and contracts for maintenance support in FPDS will be used to determine that the cost is fair and reasonable. 7. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: GSA was used as a market research tool, but no authorized distributors are available via Federal Supply Schedule. Wolters Kluwer confirmed that there is only one company, ProVation, which is capable of providing software maintenance. 8. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: The company, Wolters Kluwer, was contacted to locate companies authorized to provide the software maintenance. 9. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and SIGNATURES REDACTED Wolters Kluwer was contacted to determine authorized distributors. They responded that ProVation is the only company allowed to provide maintenance to the ProVation GI software. 6.
