Description
U.S. General Services Administration GSA Region 7 Leasing Division Justification for Other than Full and Open Competition Lease Number: GS-LTX16121 Project Number: 4TX0887 Agency Name: DHS-USSS, FDA, and DCMA 1. Nature and/or description of the action being approved: To exercise an unevaluated five year renewal option for the Department of Homeland Security's United States Secret Service (or DHS-USSS), the Food and Drug Administration (or FDA), and the Defense Contract Management Agency (or DCMA) at 1801 Allen Parkway, Houston, TX 77019. The DHS-USSS, FDA, and DCMA did not provide requirements on time to GSA, and the current lease expires on May 13, 2017 and a renewal option is an appropriate acquisition vehicle to protect the Government's leasehold interest. Therefore, it is recommended that GSA exercise this renewal option. GSA will have termination rights during the renewal option. 2. Description of the supplies or services required to meet the agency's needs (including estimated value): The DHS USSS currently occupies 31,009 ABOA square feet (38,761.25 RSF) of office type space, the DCMA occupies 6,811 ABOA square feet (8,514 RSF) of office type space, and FDA occupies 3,254 ABOA square feet (4,068 RSF) of office type space at 1801 Allen Parkway, Houston, TX 77019. The current lease no. LTX16121 expires May 13, 2017. The proposed action is to exercise a five-year unevaluated renewal option under the current lease. The Government will possess termination rights under this renewal allowing the Government to terminate the lease in whole or in part by giving at least 120 days written notice to the Lessor. The current annual rent is $1,211,921.81 or $23.60 per RSF. The Bullseye target is $32.55 per RSF (see attachment 1). Our goal is to exercise a renewal option at a rate not to exceed 10% above the Bullseye target, or $35.81 per RSF. The anticipated annual rent is $1,176,771.10 considering the lease's current Amortized Custom and General Tenant Improvements are scheduled to finish at the lease's expiration. The aggregate rental for this five-year renewal is $5,883,855.55. 3. Identification of the statutory authority: 41 U.S.C. 253 (c) (1) and FAR 6.302-1. Only one responsible source and no other supplies or services will satisfy agency requirements. 4. Demonstration that the proposed contractor's unique qualifications or nature of the acquisition requires use of the authority cited : In accordance with GSAM 570.402-1, a cost-benefit analysis indicates that award to an Offeror other than the present Lessor will result in relocation costs or duplication of costs to the Government, and the Government cannot expect to recover such costs through competition. The completion of the attached cost benefit analysis demonstrates that it is in the Government's best interest to remain at the current location. Please see the attached cost benefit analysis for details. 5. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable: On July 28, 2016, a Bullseye report provided market research within the Allen Prwy/Montrose using CoStar, REIS, and CBRE data. In addition, an advertisement was placed on Federal Business Opportunities (FBO) on January 11, 2017 with notice of intent. 6. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable: GSA is currently paying $23.60 per RSF, fully serviced for 51,343 RSF at 1801 Allen Parkway, Houston, TX 77019. On July 28, 2016, a Bullseye report provided market research within the Allen Prwy/Montrose using CoStar, REIS, and CBRE data. In addition, an advertisement was placed on FBO on January 11, 2017 with notice of intent. According to Bullseye market data, the target rate is $32.55 per RSF. If GSA exercises the five-year renewal option the anticipated rate will not exceed 10% above the Bullseye target, or $35.81 per RSF. A cost-benefit analysis indicates that award to an Offeror other than the current Lessor will result in relocation costs or duplication of costs to the Government, and the Government cannot expect to recover such costs through competition. As a result of the above information, the Contracting Officer has determined that the anticipated rental rate is considered fair and reasonable. 7. Description of the market research conducted: Bullseye market data and FBO advertising. 8. Other facts supporting the use of other than full and open competition: The current Lessor is responsive and is meeting the requirements of the lease. The current leased location meets the agency's requirements. 9. List of any sources that expressed in writing an interest in the acquisition: An advertisement was placed on FBO on January 11, 2017 GSA received 1 expression of interests, including the incumbent lessor, which are: Incumbent: 1801 Allen Parkway, Houston, TX 77019 10. Statement of actions the agency may take to remove or overcome any barriers to competition: The DHS-USSS, FDA, and DCMA have not provided GSA with their long term lease requirements. Therefore a Renewal Option must be put in place to avoid a Holdover. 11. CONTRACTING OFFICER CERTIFICATION: By signature on this justification for Other than Full and Open Competition, the Contracting Officer certifies that the award of a lease renewal of 51,343 RSF is in the Government's best interest and that this Justification is accurate and complete to the best of my knowledge and belief. 12.
