INTRODUCTION THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION. The National Heart, Lung, and Blood Institute (NHLBI), Office of Acquisitions (OA), intends to negotiate and award a purchase order on a noncompetitive sole source basis to Nikon Instruments Inc., 1300 Walt Whitman Rd Fl 2, Melville, NY, 11747-3001, to procure preventative maintenance and emergency repair services for the LMC's Nikon A1R and Nikon N-STORM microscopes for a period of one (1) base year and four (4) option years. BACKGROUND The Light Microscopy Core (LMC) of the National Heart Lung and Blood Institute (NHLBI)'s Division of Intramural Research (DIR) is the main source of light microscopy equipment for roughly 10 Branches/Centers of scientific-medical research at the NHLBI. The LMC has two microscopes which are coming off of warranty on 12/31/16 -a Nikon A1R Laser Scanning Confocal Microscope (S/N: 30505) (aka A1R) and a Nikon N-STORM system (S/N: x-7507) (aka. STORM). PURPOSE Like other LMC equipment, it is imperative that the A1R and STORM are properly maintained. Extended down-time of and/or poorly calibrated equipment would be catastrophic to many research projects throughout the DIR. Therefore, the LMC is in need of a long-term maintenance contract to ensure both instruments are performing optimally without interruption. PROCUREMENT The Contractor shall provide preventative maintenance and emergency repair services for the LMC's Nikon A1R and Nikon N-STORM microscopes for a period of one (1) base year and four (4) option years. (Maintenance on the N-STORM will continue through Option Year 2 only). Services provided will be in accordance with the Contractor's standard maintenance agreement terms JUSTIFICATION Nikon Instruments, Inc. (Nikon) does not authorize other companies to maintain its products. As a result, Nikon is the only company with the knowledge, training and equipment necessary to perform all forms of maintenance on the Nikon A1R and Nikon STORM microscopes. The use of any company other than Nikon to maintain the equipment will void any manufacturer warranties. Due to this, Nikon Instruments is the only vendor capable of fulfilling the Government's requirement. REGULATORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulations (FAR) Subpart 13.106-1(b), soliciting from a single source (for purchases not exceeding the simplified acquisition threshold) and only one responsible source and no other supplies or services will satisfy agency requirements. ADDITIONAL INFORMATION Industry Classification (NAICS) Code is 811219, Other Electronic and Precision Equipment Repair and Maintenance, and the Small Business Size Standard is $20.5M. The acquisition is being conducted under FAR Part 13, Simplified Acquisition Procedures, therefore the requirements of FAR Part 6, Competitive Requirements, are not applicable (FAR Part 6.001). The resultant award will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 05-92-1 (December 19th, 2016). This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. All responses must be received by December 28, 2016 at 9:00AM EST and must reference synopsis number NHLBI-CSB-HL-2017-055-KMA.
