INTRODUCTION THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION. The National Heart, Lung, and Blood Institute (NHLBI), Office of Acquisitions (OA), intends to negotiate and award a purchase order on a noncompetitive sole source basis to Becton Dickinson and Company, 2350 Qume Drive, San Jose, CA, 95131, to procure a maintenance contract for the Flow Cytometry Lab's BD Fortessa Flow Cytometer Analyzer. BACKGROUND The Flow Cytometry Core is a state-of-the-art facility to accommodate a range of cell sorting and analysis needs. The mission of the lab is to provide state of the art analysis and sorting of cells using flow cytometry. A wide variety of applications are supported including high speed cell sorting, 15-color cell analysis, cytokine analysis by multiplex bead arrays, imaging flow cytometry, phoshoprotein analysis, and cell cycle analysis. It is critical for the ongoing clinical research protocols at NHLBI that the lab's equipment is kept in the best condition possible. A service contract with the manufacturer of the equipment is the only way we can guarantee that the equipment will be functioning properly when it is needed. PURPOSE The purpose of this acquisition is to procure a maintenance contract for the Flow Cytometry Lab's BD Fortessa Flow Cytometer Analyzer. This machine is a critical part of the lab's focus, and the machine's highly complex and sensitive electronics must be regularly serviced by specially trained engineers in order to function properly. PROCUREMENT Coverage shall include the BD LSRFortessa Special Order System with one Computer Workstation (excluding lasers and printers) for labor, travel expenses and parts (excluding consumables), for the following: •2 Preventive Maintenance Inspections to be performed during a twelve-month period, including 2 PM Kits. •Software Revisions released during the Agreement term. •Unlimited service visits, Monday-Friday, excluding BD Biosciences holidays. •Unlimited telephone support for instruments, reagents and applications will be provided at no additional charge. •Every reasonable effort will be made to respond to a request for emergency on-site service (Monday through Friday, excluding BD Biosciences holidays) within 48 hours. JUSTIFICATION The BD Fortessa Flow Cytometer Analyzer, (serial#: H17700018) is a special order cytometer with our specific requirements to match our other existing machinery. The configurations, electronics, filters, etc. have been specifically matched for the purpose of cross compatibility and utility excellence for optimal cell analysis and sorting of experiments. Consistency among cytometers is absolutely necessary for experiment validation and perfection in results. This cytometer is manufactured only by BD Biosciences, and the parts and processes are proprietary. In order to comply with the machine's warranty, it is mandatory that service is provided by BD Qualified Engineers. These are all specific requirements that only BD Biosciences can provide. REGULATORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulations (FAR) Subpart 13.106-1(b) Soliciting from a single source (for purchases not exceeding the simplified acquisition threshold) and only one responsible source and no other supplies or services will satisfy agency requirements. ADDITIONAL INFORMATION Industry Classification (NAICS) Code is 811219, Other Electronic and Precision Equipment Repair and Maintenance, and the Small Business Size Standard is $20.5M. The acquisition is being conducted under FAR Part 13, Simplified Acquisition Procedures, therefore the requirements of FAR Part 6, Competitive Requirements, are not applicable (FAR Part 6.001). The resultant award will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 05-92 (November 18, 2016). This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. All responses must be received by December 20, 2016 at 9:00AM EST and must reference synopsis number NHLBI-CSB-(HL)-2017-048-KMA.
