Description
This is a notice of intent to award a sole source contract under the statutory authority of 10 USC 2304(c) (1), as implemented by Federal Acquisition Regulation 6.302-1(a)(2)(ii)(A) and (B), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements when it is likely that award to any other source would result in substantial duplication of cost to the United States which is not expected to be recovered through competition and unacceptable delays in filling the agency's requirement. The Government has conducted extensive market research leading up to development of its acquisition strategy, issuing Request for Information (RFI), Reference Number FA8818-16-R-0024 (Posted 25 February 2016). The industry responses have identified a future potential for competition of the requirement for certified Minuteman Flight Termination Systems (MM FTS Hardware). However, at this time, there are no other contractors who are capable of providing delivery of this hardware within the required timeframe and without substantial cost duplication including additional pass-through costs of non-ordnance producing contractors. Cost duplication of ordnance producing contractors would include: flight hardware modification and associated drawing, engineering, and procedures updates required to integrate a new MM FTS design with launch vehicle contractor hardware; AF installation documentation updates and technician training; and increased mission assurance support through all phases including updates to AF training and installation procedures, users guides, and range safety documentation. These requirements for a new MM FTS design also significantly push out the schedule at which first use of the new design could commence which is unacceptable for an immediate requirement. This sole source contract will allow Pacific Scientific Energetic Materials Company (PSEMC) to provide/deliver Modular Mechanical Ordnance Destruct System (MMODS) components as the MM FTS hardware components. PSEMC is able to provide MMODS with no additional pass-through costs, and no additional costs for integrating with launch vehicle contractor's existing hardware. They are also able to best utilize the inert government furnished property available from previous unused and expired MMODS kits, and they are able to deliver the requirement within the schedule critical path. While this notice of intent is for informational purposes only, and is not a request for competitive proposals, interested parties (to include small and small disadvantaged businesses) may identify their interest and technical capability, and submit information which will be considered by the agency for a future competitive requirement. The applicable NAICS code is 336419 with a corresponding size standard of 1,000 employees. This announcement constitutes the only notice for this effort. This acquisition action does not assume that PSEMC is the only contractor who can complete this action. This action only assumes that there are no contractors, at this time, who are capable of providing this equipment without substantial duplication of costs and within the required schedule. The Justification and Approval document will be made available on FBO within 14 days of contract award.
