Description
JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY 1. Contracting Activity:Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 23 Christopher Way Eatontown, New Jersey 07724 2. Description of Action: The proposed action is for a firm-fixed price delivery order issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) V Governmentwide Acquisition Contract (GWAC). 3. Description of the Supplies or Services: VA, Office of Information and Technology, Austin Information Technology Center (AITC) has a requirement for the procurement of four brand name DataOn storage bundles for the existing Veterans Informatics and Computing Infrastructure (VINCI) environment. The DataOn storage bundles also include a three year defective part with advanced replacement warranty and three year Defective Media Retention (DMR) no-return replacement for failed Serial-Attached SCSI solid-state drives. The procurement of DataOn's storage bundles and warranty will upgrade the existing storage environment while minimizing the space and cabling used on the floor at AITC. It will also provide an enhancement of the environment's networking capability. Cables, storage configurations, adapters, and hard drives components shall be procured on a brand name or equal basis and are not part of this justification, but are part of this procurement in addition to the aforementioned brand name storage bundles and warranty required. The required DataOn products shall be delivered within 30 days of delivery order award and include a three-year warranty covering defective parts and advanced replacement and three year DMR no-return replacement for failed Serial-Attached SCSI solid-state drives. 4. Statutory Authority: The statutory authority permitting an exception to fair opportunity is Section 41 U.S.C. 4106(c) as implemented by the Federal Acquisition Regulation (FAR) 16.505(b)(2)(i)(B), entitled "Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized." 5. Rationale Supporting Use of Authority Cited Above: The required brand name DataOn storage bundles and warranty will be used to upgrade the current VINCI DataOn Infiniband network storage solution located within the AITC. The storage solution must provide for the InfiniBand network connectivity using a DataOn Statistical Analytical Services storage disk shelf that is certified for Microsoft Windows storage spaces. It is critical that the products procured be 100% compatible with the existing VINCI environment out-of-the-box. Acquiring a disk shelf made by a brand other than DataOn would void the maintenance warranty and VINCI personnel would no longer be able to get maintenance support services. Storage shelves from brands such as Hewlett-Packard (HP), Dell, or EMC would not physically fit or function in the current environment. Failure to procure DataOn storage under this procurement would create potential vulnerabilities within the VINCI environment with malfunctioning drivers and incompatibility would cause data corruption or data loss, slow processing, and put personally identifiable information/personal health information at risk. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. It was determined that limited competition is viable among DataOn authorized resellers for this brand name effort. In accordance with FAR 5.301 and 16.505(b)(2)(ii)(D), this action will be synopsized within 14 days of award on the Federal Business Opportunities Page. In addition, in accordance with FAR 16.505(a)(4)(iii), the Justification for an Exception to Fair Opportunity shall be posted to NASA SEWP V GWAC website along with the solicitation. 7. Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are changes in the market place that would enable future actions to be competed. 8. Market Research: Market research efforts were conducted by VA technical experts from VINCI in March 2016. The market research included a thorough review of various websites and trade publications and discussions with data managers and researchers in VA to ascertain if there are other similar items that can meet the Government's requirements. Specifically, VA technical experts from VINCI researched storage from Dell, HP, and EMC; however, none of these three storage environments offer would physically fit or function in the current environment as mentioned in section five. Additionally, the VA technical experts conducted a Request for Information (RFI) in May 2016 on NASA SEWP V GWAC. Responses were received from four vendors, one of which was a Service-Disabled Veteran-Owned Small Business. Based on this market research, it was determined that only DataOn storage bundles and warranty can meet the Government's requirements. The Contract Specialist performed additional market research in June 2016 using the NASA SEWP V GWAC Provider Lookup Tool, which identified numerous authorized resellers of the required DataOn products. 9.
