- The Federal Bureau of Investigation (FBI) intends to award a sole source purchase order to Velocity Software Inc, 196-D Castro Street, Mountain View, CA 94041 for the following service for a base year and four option years: - zVPS Long-Term Lease License Renewal Fee/Processor: (CEC1) 2097-E64 s/n: 02-00200B2/QTY 1 - IFLs QTY 36 - zTUNE Performance service QTY 1 - zVPS Long-Term Lease License Renewal Fee/ProcessorCEC2) 2097-E64 s/n:02-0200A2/ QTY 1 - IFLs/QTY 16 - zTUNE Performance Service/QTY 1 This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-88, the North American Industry Classification System (NAICS) is 511210 with a business size standard of 6.5 million dollars. A quote is being requested under solicitation no. DJF-16-2000-PR-0001504 using Simplified Acquisition procedures. This will be a fixed price contract. Based on FBI market research, it has been determined that Velocity software maintenance is the only source to meet the FBI requirement and no other supplies or services will satisfy the agency requirements. Velocity Software, Inc. is the sole proprietary manufacturer and provider for this software. zVPS is a product developed, owned and distributed by velocity software. They are the only source for licensing maintenance or renewing the license. They have no authorized resellers capable of supplying maintenance and licensing of the zVPS product suite, as well as zTUNE, zMAP, zMON, zTCP, zVWS and zPRO. The proposed contract action is for maintenance for which the Government intends to solicit and negotiate with only one source under the authority of TLE 41, usc (c) (1). This notice is not a request for competitive proposals. Interested parties may indentify their interest and capability to respond by submitting a proposal to include technical qualifications and experience/pricing and any other information to Andrea K. Walker, Contracting Office, and address listed above. The following clauses and provisions are incorporated by reference and apply to the acquisition: FAR 52.212-1, Instructions to offeror-Commerical Items (OCT 2015): FAR clause 52.212-2, Evaluation Commercial Item (OCT 2014), FAR clause 52.212-4 Contract Terms and Conditions Items (MAY 2015); FAR 52.212-5 clause, Contract Terms and Conditions Required to Implement Statutes or Executive Orders Commercial Items (MAR 2016). Each offeror shall include a complete copy of the clause 52.212-3 Offeror Representations and Certifications - Commercial Item (APR 2016). A determination by the Government not to compete this proposed required is based upon responses to this notice and is solely within the discretion of the Government.
