Description
JUSTIFICATION FOR SOLE SOURCE OR ACCEPTANCE OF ONLY ONE SOURCE For Purchases Under The Simplified Acquisition Threshold (150K and Under) Fund Control Number: R1E30001 The contracting office at FCI Berlin has determined the procurement of emergency electrical repair service from Royal Electric, meets the criteria established for only one source reasonably available. This limitation of competition is justified as supported by the following information: 1. In accordance with FAR 13.106-1 (b) (1) (i), only one responsible source was solicited for an urgent procurement to satisfy and agency need. This action is for the diagnostic /maintenance/repair service for the switch gear in the Powerhouse and blown transformer. The switch gear in the Powerhouse supplies power to the institution. At the time of urgency the switch gear had exploded and caused a blackout power outage for the entire institution. This created an emergency within the institution as a power outage creates a hazardous environment for staff and inmates. Therefore, the solicitation for an electrical contractor was limited to one source due to urgency. 2. In accordance with FAR 13.106-3 (a), the charge for services provided by Royal Electric have been determined to be fair and reasonable based upon the following information: The urgency of repair, and the comparison to an independent government estimate. In addition, each item presented on the contractor's quote was reviewed by the Contracting Officer's Representative (COR) and Contracting Staff to ensure price was reasonable with market research in the area for items such as labor, material costs, and mobilization. 3. This is a sole source action and, in accordance with FAR 13.106-3 (b)(3) (i) & (ii), the absence of competition in this procurement is that Royal Electric is knowledgeable in switch gear testing and transfomer repair. Royal Electric specializes in large capacity " high-voltage" electrical work and was available for repair diagnosis within 12 hours of the emergency situation.
