Description
Description of Services: Provide professional support and business aid to the customer in pre-award and post-award functions (excluding negotiation), using a wide range of contracting methods and types, for complex and diversified architectural engineering services and construction. 2.1.1 The tasking typically involves varied obligations requiring many different and unrelated processes and methods. Assignments involve pre-award, post-award, and price/cost analysis functions containing a variety of complexities. Using knowledge of a variety of contract types, and price/cost analysis, analyzes difficult contracting issues and recommends appropriate course of action. 2.1.2 Provide business recommendations and aid to technical personnel involved in development of the statement of work or data requirements. Reviews requisition package for adequacy and compliance with administrative, regulatory, and procedural requirements and consistency with current market practices and conditions and provides recommendations to contracting officer. Recommendations are based on analysis of alternatives, adaptation or modification of procedures, or resolution of incomplete or conflicting technical or contractor data. The task requires making recommendations concerning such issues as the interpretation of a considerable amount of technical data and policy and regulatory information. 2.1.3 Provide aid in the planning and coordination of procurement activities for the pre-award, post-award, or other contractual functions. The procurement analyst independently plans and carries out the tasking, selecting the approaches and techniques to be used. The contractor shall resolve conflicts that arise. The contractor shall inform the contracting officer of potentially controversial matters, or those with far-reaching implications. 2.2. Planning: Perform the following planning tasks: market research/analysis to determine availability of the requirement; analyze market trends, conditions and technological advances; and recommend appropriate contracting techniques and procedures to solve various acquisition problems. Analyze difficult contracting issues and recommended course of action, which may depart from previous approaches. 2.2.1 Provide business recommendations and aid to technical personnel involved in development of the statement of work or data requirements. Review and provide recommendation of adequacy of requisition package for compliance with administrative, regulatory, and procedural requirements and consistency with current market practices and conditions. Review and evaluate requisitions for which previous experience and cost data are not usually directly applicable, such as architectural design or construction of buildings involving unusual design features or site adaptation. Review procurement requests and provides recommendation on whether, based on market analysis, the requirement can be performed by small businesses; actively solicit Small Business/Small Disadvantaged Business/Women Owned (SB/SDB/SWO) participation; Hub Zone consideration, and review for compliance subcontracting plans, if applicable. 2.2.2 Provide aid in the development of evaluation criteria to use in determining source selection and "best value" requests for proposal which include utilization of past performance data and technical qualifications for awards other than lowest price. Procurements usually involve a variety of complexities such as socioeconomic considerations, complex evaluation factors, difficult to define scopes of work, legal conditions, rigid deadlines, or incentive arrangements causing additional complications. Provide recommendations to resolve problems that limit competition. 2.3. Procurement Services: The procurement analyst shall analyze requirements and recommend method of procurement considering a wide range of contracting methods and contract types. Contracts contain a variety of complexities such as specialized terms and conditions, unfavorable market conditions, complex, and limited competition or sole source due to urgency. In sealed bidding procurements, prepare for approval properly structured bid schedule, draft solicitation, arrange pre-bid conferences and prepare documentation on conference results. Assist in the processing of protest documents. 2.3.1 Perform analysis of financial and technical information provided in response to solicitation. For negotiated agreements, analyses requirement statements and provide recommendations for change, draft solicitation, arrange pre-proposal conferences and prepare documentation on conference results. 2.3.2 Participate in conferences to discuss, analyze offer received; perform price or cost analysis; aid in planning government objectives for government personnel to negotiate price, technical requirements, terms and conditions of the contract. Prepare contract documents to include appropriate standard clauses and special provisions and incentives, such as price re-determination or cost and performance incentive provisions. Recommend reasons for decision. 2.4. Administration: May perform post award contract management actions on a group of contracts, such as those with cost reimbursement; and/or those with incentive arrangements. Track contractor performance for compliance with terms and conditions of contracts and notifies the contracting officer of untimely submissions based on technical progress reports and performance metrics. Reviews contractor invoices for accuracy, and provides recommendation for approval to contracting officer or recommends return, with documentation, in a timely manner. Make field site visits to detect and document any labor standards violations. 2.4.1 Recommend appropriate action to expedite delivery or performance when required by mission changes, and prepares documentation to support change orders as necessary. Analyze proposals and advise contracting officer when the contractor proposal varies significantly from the original estimates. Provide advice and documentation to support government negotiation position. 2.4.2 Recommend and prepare contract modification document caused by changes in technical requirements, in quantities, ordering un-priced options, and similar issues. Analyze price and cost elements of the proposed change(s) and provide support when a formal audit is required. Analyze complex contract administration problems, e.g., disputes and labor violations. 2.4.3 Prepare negotiation position recommendation for settlements including analysis and recommendation of allowable costs, termination inventory and determination of profit. Prepare negotiation memoranda to explain rationale and methods used in arriving at the final settlement and prepare full documentation for cases requiring formal review. Prepare recommended replies to other involved agencies, appeal boards, or congressional inquiries. Analyze difficult issues and identify alternative courses of action, which may depart from previous approaches. Prepare letters, memoranda, documents, or reports that support recommendations. Research and recommend appropriate action or interpretation of issues. 2.5. Business Aid and Correspondence: The procurement analyst shall provide professional aid and recommend guidance on contracting tasks and prepare correspondence for contracting officer signature. All actions and conduct shall be in a professional manner. 2.5.1 Provide technical aid and recommendations on acquisition and business related issues. Assist providing training to contractors and customers on contractual language, legal responsibilities, and opportunities. Prepare letters, memoranda, documents, or reports that support contractual actions or recommendations for contracting officer approval and signature. All correspondence will be signed by the contracting officer. 3.0. Additional Requirements and Notes: 3.1. Desired Master's Degree in a Business discipline. Possess expertise in the area(s) required by the contract with a demonstrated knowledge of Government regulations, manuals, pertaining to procurement. Minimum 7 years of experience in business, contracting or related area with demonstrated experience in contract formation and administration matters. Possess a demonstrated ability in planning and coordination of procurement activities for pre-award, post-award and other contractual functions; knowledge of a variety of contract types, and price/cost analysis, analyze difficult contracting issues and recommends appropriate course of action. Provide business recommendations and aid to technical personnel involved in development of the statement of work or data requirements. Other combinations of experience and education that meet the minimum qualifications may be substituted. 3.2. Possess additional Army/Air National Guard experience that demonstrates the individual is prominent and recognized authority in the subject matter field or area of consultation and has broad knowledge and skills to perform the work of the position described in the Contract. The Contractor shall have expert working knowledge of Federal, DoD, Army and National Guard procurement regulations; National Guard Engineering regulations and instructions; agency standard operating procedures and safety issues. 3.3. The contractor shall comply with the following Government directives in order to successfully complete the tasks: • Federal Acquisition Regulation (FAR) • Defense Federal Acquisition Regulation Supplement (DFARS) • Army Federal Acquisition Regulation Supplement (AFARS) • National Guard Acquisition Manual (NGAM) • Engineering Technical Letters and Series 32 Regulations and Instructions • Applicable Guard (Army/Air) Acquisition Policy Letters • Case Law • Comptroller General Decisions • Office Operating Instructions
