- NAVSUP Fleet Logistic Center San Diego-Seal Beach Detachment intends to issue a sole source purchase order in accordance with FAR part 12 and Part 13 to ORCINA Limited, the manufacturer based on Daltongate, Ulverston, Cumbra LA12 7AJ United Kingdom. Jacob Technologies and Software is the only authorized dealer in the US. NAVFAC EXWC Code CIOFP4, currently maintains 1 OrcaFlex licenses for design and analysis of mooring systems and installation methods on 3 computer systems and employees have been used for the past 8+ years and have invested several man-years in acquiring experience and expertise in the use of the OrcaFlex software. NAVFAC EXWC, Pt Hueneme Ca. The government intends to solicit and negotiate with only one source under the authority of Section 4202 of the Clinger-Cohen Act of 1996 and as implement under FAR 13.106-1(b)(1). This is the annual licensing and maintenance service contract for one current owned OrcaFlex software products. The maintenance service is required to stay current on all software updates and revisions. It allows access to customer service and technical and administrative questions about the software capabilities, functions and/or malfunctions. The maintenance service contract is only available through the software manufacturer and cannot be purchased from any other 3rd party vendors. ORCINA Limited currently had full intellectual property rights and owns the OrcaFlex software. It is the only authorized source for providing maintenance to the OrcaFlex software. Switching over to a new system would be cost prohibitive as any equivalent system or systems, would have initial costs up to 5 times the licensing fee and the Government would still have to pay similar annual licensing and maintenance fees as well as countless hours of training for employees to learn a new system.. THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE QUOTES. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Interested parties shall submit information that indicates their ability to satisfy this requirement via e-mail to janet.nunez@navy.mil requests must include company name, address, and POC name telephone number. CAGE code, DUNS number, NAICS code, application business size and tax ID number. Responses are due by August 13, 2016, 8:00 AM, Eastern Standard Time. If no responses are received, FLCSD-SEAL BEACH will proceed with the sole source award.
