Estimated Value: Base Year: $XXXX.XX PSC/FSC: 6640 NAICS Code: 334516 1.OBJECTIVE: Equipment procurement for add-on modules to VA Owned Device. Manufacturer Cepheid. Sole Source, Firm Fixed Price, Open Market Purchase Order for delivery and installation of additional modules to perform more tests at one time. 2.MARKET RESEARCH SOURCES for: XXXX SUPPLIES: Equipment purchase for additional modules for the Cepheid Genexpert SERVICES: 3.BACKGROUND: This is a new request to add these additional modules into this device. This will be an open market procurement. The manufacturer has stated that they do not have this available for distribution through any other Large or Small Business. The manufacturer is the sole manufacturer and distributor for Cepheid Devices. There is no other generic modules available to perform these tests due to proprietary trademark laws. 4.MARKET RESEARCH FINDINGS: a."Mandatory" Medical FSC 65, 66 " Source per VAAR 808.002: (1) National Committed Use Contracts: This is not under any type of contract. The vendor was contacted and confirmed that this is open market. (2) Items of a type customarily available in the commercial marketplace with modifications: n/a (3) Items used exclusively for governmental purposes: n/a b.Customary practices regarding customizing, modifying or tailoring of items to meet customer needs and associated costs: n/a c.Customary practices, including warranty, buyer financing, discounts, contract type considering the nature and risk associated with the requirement, etc., under which commercial sales of the products are made: This will be procured using commercial practices. The modules will include a warranty. This will be a Firm Fixed Price purchase order. Payment will be Net 30. There is no risk to this procurement as the Manufacturer of the Brand Name Device is Cepheid. Cepheid is the sole distributor and installer of the device. d.The requirements of any laws and regulations unique to the item being acquired: N/A e.The availability of items that contain recovered materials and items that are energy efficient:n/a f.Size and status of potential sources (see Part 19): This will be a Sole Source purchase order to the manufacturer. Cepheid is a large business. There is no opportunity for small business. 6.MARKET PRICE: $XXXX.XX (F.O.B. Destination to include installation). 7.ACQUISITION HISTORY: I have located similar purchases in FPDS that date back to 2008 for similar module add-on's. The price back in 2008 is the same as it is today, $XXXX.XX. The price is determined to be Fair and Reasonable based on the history from other VA's procurements. 8.OTHER PERTINENT INFORMATION: N/A 9.RECOMMENDATION: It is my recommendation that this procurement be issued to Cephied at a Fair and reasonable cost of $XXXX.XX.
