- Justification for Other than Full and Open Competition 1. Contracting activity: The Center for Contracting, Facilities and Services' Contracti ng Grou p wil l contract for services required by the Office of Personnel Management (OPM), Federal Investigative Services in Boyers, PA. Action being approved: This is a Justification for Other than Full and Open Competition (JOFOC) in support of a procurement of postage via the Pitney Bowes Connect 3000 mail machine. This procurement will resu lt i n the issuance of a purchase order with Pitney Bowes. In the future, OPM will reassess its postal mai l requ irements and continue to seek postal procu rements that are in the best interest of the government. 3. Supplies or services required to meet the agency's needs (including the estimated value): Monies must be available in a reserve account with Pitney Bowes, to be applied to the Connect 3000 mail meter currently leased from Pitney Bowes. These funds are used to apply postage to all outgoing USPS mai l processed with this mail meter. Ifthe money is not available, the mail will not be processed. Only USPS postage is being acquired through Pitney Bowes from USPS because the currently used leased mail equ ipment is being leased from Pitney Bowes under contract. See Section 5 for related Pitney Bowes contract information. Postage/mailing services are critical to the completion and del ivery of backgrou nd investigations. This directly supports achievement of OPM strategic goal of Federal Workforce Integrity. Base Period: Award Date through - July 31, 2016 Option I - August 1, 2016 -Ju ly 31, 201 7 Option 2 - August 1, 2017 - J u ly 31, 2018 Option 3 - August 1, 201 8 - Ju ly 31, 2019 4. Statutory authority permitting other than full and open com petition: (a) [ X] 41 U.S.C. 253(c)( l ); FAR 6.302-1 - Only one responsi ble source and no other supplies or services will satisfy agency req uirements. 5. Demonstration that the contractor's u niq ue qualifications or the natu re of the acquisition req uires the use of the authority cited: The use of the Pitney Bowes Connect 3000 mail meter allows streamline processing and payment for USPS mai l. Currently, OPM: FIS has a 60 month lease of Pitney Bowes equipment for the processing of outgoing USPS mail (Connect 3000 equipment) (ref. OPM I 5-14-F-0122). OPM is entering into Option year 2 of this lease. Pitney Bowes postal metered mail equi pment previously purchased by OPM can only utilize United States Postal Service (USPS) postage acqu ired by Pitney Bowes from the USPS. Per the Private Express Statute, OPM is req uired to use USPS postage. Private Express Statute consists of 18 U.S.C. §§ 1693-1696 and 39 U.S.C. §§ 601-606, implemented under 39 Code of Federal Regu lations Parts 310 and 320, which restrict the carriage and del ivery of letter mai I. OPM intends to align this purchase order to run concurrently with the remai ning option periods. Base Period: Award Date through - Ju ly 31, 2016 Option I - August 1, 2016 - July 31, 2017 Option 2 - August I, 201 7 - July 31, 2018 Option 3 - August 1, 201 8 - J u ly 31, 2019 6. Efforts made to ensure that offers are solicited from as many potential sources as is practicable, includ ing whether a notice was or will be pu blicized as req uired by Subpart 5.2 and, if not, which exception u nder 5.202 applies: The following efforts were made to sol icit offers from more than one company: None. Pitney Bowes is the only entity able to load postage on a Pitney Bowes mai l meter. The rate for postage is set by the USPS and Pitney Bowes does not charge for loading postage on the meter. Appl ication of synopsis req u irement: (g) [X] Market research was performed by contacting knowledgeable ind ividuals i n government and ind ustry. 7. Determination by the contracting officer that the anticipated cost to the Govern ment will be fair and reasonable: Postage rates are set by the USPS. Pitney Bowes postal metered mai l equipment uses USPS rates that were previously negotiated and set buy the USPS. 8. Description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted: Per the Private Express Statute, we are req u ired to use the Postal Service. 9. Other facts supporting the use of other than full and open com petition: By using the Pitney Bowes Connect for processing USPS mai l, OPM qualifies for Com mercial discount rates with the USPS. Per the Private Express Statute, we are requ ired to use the Postal Service. 10. Sources that expressed, in writing, an interest in the acquisition: None. 11. Actions the agency may take to remove or overcome any barriers to com petition before any subseq uent acquisition for the supplies or services req uired: There are no plans for subsequent procurement actions at this time. I n the future, OPM wi l l reassess its postal ma i l requ irements and continue to seek procurements that are in the best interest of the government.
