Description
Solicitation Justification and Approval for Sole Source The U.S. Army Corps of Engineers, Portland District intends to award a sole source, firm-fixed-price contract to the Columbia River Intertribal Fish Commission (CRITFC), a Tribal Government organization, for Columbia River cultural resource protection, cultural resource training, and law enforcement data system access services. Cultural resource protection services to be provided: Contractor shall carry out Law enforcement services in conjunction with Portland District. The Corps will coordinate and communicate with other members of the Federal Columbia River Power System (FCRPS) Cultural Resources Cooperating Group, Wana Pa Koot Koot (WPKK) group, to obtain specific recommendations for cultural resources protection. Contractor shall perform patrols, investigations, surveillance, appear as a witness in court proceedings when necessary, and perform any other work not noted here that is incidental to any discoveries. Contractor shall consult with other federal, state, and local law enforcement agencies, as necessary, to complete the tasks. Contractor shall provide increased law enforcement services on Corps managed lands along the Columbia River in Zone 6 from below Bonneville Dam (west) to McNary Dam (east). Cultural resource training services to be provided: Contractor shall supply all labor and materials necessary to provide cultural resources protection training to eligible Corps employees, other federal, tribal, state, county and local law enforcement officers, as well as federal and state judiciary representatives. The course shall cover best practices for law enforcement investigations, crime scene protection, prosecution of violators, evidence collection, looter tools, looter tricks and tactics, and other key issues. Law enforcement data system access services to be provided: Contractor shall provide law enforcement data system (LEDS) communication services to eligible Portland District staff (Bonneville, The Dalles, John Day and Willow Creek) and Walla Walla District staff (McNary Dam) who work at projects along the Columbia River. Corps will access LEDS for the sole purposes of ranger safety and enforcement. CRITFC was created in 1977 and grew out of US v. Oregon (1969). The legal standing of CRITFC is based in Treaty Reserved Rights and only the Affected Tribes can direct the policy of CRITFC. CRITFC staff for this work are recognized by the State of Washington and the State of Oregon as certified Peace Officers and have the experience ensuring the integrity of historic properties is maintained under National Historic Preservation Act (NHPA) and enforcing the Archaeological Resources Protection Act (ARPA) and Native American Graves Protection and Repatriation Act (NAGPRA). CRITFC has been approved by the Wana Pa Koot Koot tribal council to conduct these services on behalf of local tribes. A responsible source must be authorized by the Wana Pa Koot Koot tribal council to conduct this work on behalf of the following tribes: Confederated Tribes of Warm Springs of Oregon, Confederated Tribes of the Umatilla Indian Reservation, Confederated Tribes and Bands of the Yakama Nation, and the Nez Perce Tribe.
