Description
INTRODUCTION THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A PURCHASE ORDER WITHOUT PROVIDING FOR FULL AND OPEN COMPETITION (INCLUDING BRAND-NAME). The National Heart, Lung, and Blood Institute (NHLBI), Office of Acquisitions (OA) on behalf of The National Institute of Dental and Craniofacial Reseach (NIDCR) intends to negotiate and award a Purchase Orderd without providing for full and open competition (Including brand-name) to Lab Products for the Hydropac Master Carton for the NIDCR owned Hydropac 2500 Alternative Water System. NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE The intended procurement is classified under NAICS code 314999, All Other Miscellanious Textile Product Mills, with a Size Standard of 500 employees. REGULATORY AUTHORITY The resultant Purchase Order will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 05-86 effective 01 JAN 2016. This acquisition is conducted under the procedures as prescribed in FAR subpart 13.5-Test Program for Certain Commercial Items and FAR subpart 12-Acquisition of Commercial Items at an amount exceeding the simplified acquisition threshold ($150,000) and not exceeding $7.0 million. STATUTORY AUTHORITY This acquisition is conducted under the authority of 41 U.S.C. 253(c) under provisions of the statutory authority of FAR 6.302-1-Only one responsible source and no other supplies or services will satisfy agency requirements 41 U.S.C. 253(c)(1) DESCRIPTION OF REQUIREMENT Background The NHLBI is seeking small businesses with the ability to provide the National Institutes of Health (NIH)/National Institute of Dental and Craniofacial Research (NIDCR)/Division of Intramural Research (DIR)/Office of the Director (OD)/Veterinary Resources Core (VRC) with the Hydropac® HYP-2524 Master Carton with 72,000 valves and 36 rolls of pouch film, to the NIDCR. The National Institutes of Health (NIH) is the nation's leading medical research agency and the primary Federal agency conducting and supporting medical discoveries that improve people's health and save lives. The mission of the National Institute of Dental and Craniofacial Research (NIDCR) is to improve oral, dental and craniofacial health through research, research training, and the dissemination of health information. The function of the Veterinary Resources Core (VRC) is to provide husbandry, veterinary care, research technical support, assistance in the writing of Animal Study Protocols, and education and assistance regarding interpretations of animal use regulations, and health and safety policies. The VRC currently owns a Lab Products Hydropac® AWS-2500 Pouch Machine that utilizes the Hydropac® Master Cartons to distribute filtered water to the VRC rodent population. Purpose and Objectives The purpose of this acquisition is to provide the NIDCR owned Hydropac® Alternative Watering System with the Hydropac® Master Cartons in order to provide the 1,500 mice currently supported by the facility with highly filtered water keeping them hydrated and alive. Period of Performance Base Year: February 12th, 2016 - February 11th, 2017 Option Year 1: February 12th, 2017 - February 11th, 2018 Option Year 2: February 12th, 2018 - February 11th, 2019 Option Year 3: February 12th, 2019 - February 11th, 2020 Option Year 4: February 12th, 2020 - February 11th, 2021 Delivery upon request by Government Project Description Contractor Tasks: 1) The contractor shall provide the following: a. Lab Products Hydropac® Alternative Watering system, Quantity: 2, Product code: HYP-2524 i. The HYP-2524 Master Carton provides materials to produce 72,000 Hydropac TM Sterile Disposable Valve TM assemblies, and 36 rolls of pouch film, stored in <14.7 sq ft (<1.4 sq m). 2) Shipping Requirements a. The vendor will notify customer via email or phone of expected delivery date; b. The product shall be delivered on pallet between the hours of 7 a.m. and 3:00 p.m.; c. The product shall be boxed and or shrink wrapped so that they are easily identified for individual use by case or roll or box; d. The size of the supplies should not exceed the size of a regular pallet and stacked no higher than 7 ft.; e. The vendor shall supply a detailed list of line items provided. Other Important Considerations 1) Product must be compatable with the Hydropac® 2500 AWS. CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION Justification Rationale: Only one source is available including brand name justification: The determination by the Government to make a single-sole source is based upon the market research conducted as prescribed in FAR Part 10-Market Research, specifically the results of the market research concluded that Lab Products Inc, the manufacturer of the Hydropac® Master Carton, is the sole provider of the aforementioned product. The NIDCR currently owns a Lab Products Hydropac® 2500 Alternative Watering System to hydrate the several thousand mice in the animal lab. The Hydropac brand is federally trademarked and utilizes the Lab Products Hydropac® Master Cartons accessories to hydrate the Mice. No other contractor can provide the Hydropac® Master Cartons. CLOSING STATEMENT This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov." A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. All responses must be received by Febraury 8th, 2016 9:00 AM EST and must reference number NHLBI-CSB-DE-2016-072-KEW.
