- Sole Source Justification This is a combined synopsis and solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6-Streamlined Procedures for Evaluation and Solicitaiton for Commercial Items, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested and a written solicitation will not be issued. Request For Quotation (RFQ) number is N66604-16-Q-0538. NUWC Division Newport intends to award a Firm Fixed Price contract on a sole source basis for the following items: CLIN 0001 35 Core Annual LS-DYNA License, 1 year CLIN 0002 1 st Core Annual USA Professional License, 1 year The basis for the sole source justification to Livermore Software Technology Corporation (LSTC) is that LSTC is the only supplier for the proprietary licenses listed above. Please refer to the sole source justification. F.O.B. Destination Naval Station Newport: Newport, RI. Period of performance is 01 February 2016 to 31 January 2017. The NAICS code is 541511 ; size standard is $25M. Incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-60. The provision at FAR 52.212-1, Instructions to Offerors - Commercial Items applies to this solicitation. The provision at FAR 52.212-3, Offeror Representations and Certifications - Commercial Items applies to this solicitation. Clauses 52.212-4, Contract Terms and Conditions - Commercial Items, 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items, and DFARS 252.212-7001. Contract Terms and Conditions Required to Implement Statutes or Executive Orders Applicable to Defense Acquisitions of Commercial Items apply to this solicitation.
