- The Regional Health Contracting Office - Pacific (P) intends to award a sole source contract to Ethicon Endo-Surgery, Inc. for signal generators required for general surgery surgical and laproscopic procedures in MEDCOM Korea. These generators are the only ones compatible with existing harmonic and enseal devices. Ethical Endo-Surgery, Inc. is the sole manufacturer and distributor of these generators. The statutory authority permitting this award without providing full and open competition is 41 U.S.C.1901, as cited in 13.106(b)(1)(i) which authorizes the government to award contracts when there is only one responsible source and no other supplies or services will satisfy agency requirements.
