Description
On March 10, 2015, Federal Prison Industries, Inc. (FPI) posted a notice in FedBizOpps. In this notice, FPI announced its proposal to establish an additional category of commercial market services. Consistent with the Federal Prison Industries, Inc. (FPI) Board of Directors' directive to seek and pursue the creation of inmate work without mandatory source, this notice announces the final decision of the FPI Board of Directors to approve an additional type of commercial service, beyond the seven categories of work previously approved, to enable FPI to pursue potential growth opportunities in distribution, logistics, packaging and other services. The March 10th notice stated that, in 1998, FPI received approval from its Board of Directors to provide commercial market services. To date, the Board has approved several categories: 1) work that is currently being performed outside the United States; 2) services with a recognized labor shortage that causes companies to outsource work to foreign companies; 3) new services that a company otherwise intends to contract outside the United States; and 4) services that were performed by non-Federal Bureau of Prisons inmates (such as District of Columbia inmates) for non-Federal agencies; 5) service work for state and local governments; 6) service work that would be economically unfeasible to perform without the availability of inmate labor, i.e., new work that would otherwise not be done; and in 2013, a seventh category: work opportunities related to recycling. In January, 2015, the Board of Directors approved a proposed broadening of FPI's existing commercial market service categories. At that time, FPI received approval of its plan from the Board, subject to comment, to establish an eighth commercial market service category, to cover other potential service opportunities that do not fit into one of the other categories. This new authority will allow FPI to pursue additional commercial service work to provide more inmates with skills training opportunities. The previous notice explained that fully utilizing FPI's ability to identify additional work will assist FPI in its goal to create more inmate work. FPI's pursuit of these services should not hinder the development of the domestic market, and FPI will continue to ensure it remains sensitive so that no single industry will bear an undue burden as a result of its efforts. FPI received one written comment from an interested party regarding this proposed service, within the 30 days allowed. The comment from the interested party and FPI's response were forwarded to and reviewed by FPI's Board of Directors. After consideration, on May 28, 2015, the FPI Board of Directors approved FPI to establish an eighth commercial market service category to provide logistics, packaging, and other services on a competitive basis and without the use of FPI's mandatory source status. Interested parties have a right to raise questions at any time with FPI's Board of Directors.
