- Statement of Work Justification for Other Than Full and Open Competition This Notice of Intent is NOT a Request for Quotation (RFQ) for competitive quotes; however, in accordance with Part 6.302-1, the Federal Emergency Management Agency (FEMA) intends to award a sole source purchase order based on the authority of FAR 6.302-1 "only one responsible source and no other supplies or services will satisfy agency requirements". FEMA intends to award a purchase order to York International Corp., c/o Johnson Controls, Inc. to provide preventive and remedial maintenance services for DHS, FEMA, Mt. Weather Emergency Operations Center (MWEOC) air conditioning chiller equipment. These services will include monthly maintenance visits to provide the manufacturer's recommended preventive maintenance. The Contractor will also perform emergency repairs in case the equipment unexpectedly breaks down. A portion of the work to be performed is located in a classified area that requires a TOP SECRET security clearance to access. A DSS TOP SECRET facility clearance is required of the Contractor and any Subcontractors; individual DSS TOP SECRET clearances are required for all staff performing work under this contract at the MWEOC facility. This action is being performed in accordance with FAR 6.302-1(b)(1)(i) which states this authority may be used, "When there is a reasonable basis to conclude that the agency's minimum needs can only be satisfied by unique supplies or services available from only one source or only one supplier with unique capabilities...". A Justification for Other Than Full and Open Competition has been approved by the Contracting Officer and is provided as an attachment to this notice. Air conditioning chiller equipment manufactured by York International/Johnson Controls is installed throughout the MWEOC facility. York International/Johnson Controls is the only known responsible source for providing preventive and remedial maintenance on MWOEC's air conditioning chiller equipment because they are believed to be the only source in the area that can provide factory certified maintenance technicians who have the required DSS TOP SECRET security clearance. York International Corp., c/o Johnson Controls, Inc. is also responsible for the warranties carried on the equipment to be covered under the proposed contract. The Statement of Work (SOW) defining the preventive and remedial maintenance services required for MWEOC's air conditioning chiller equipment is also provided as an attachment to this notice. At this time, York International Corp., c/o Johnson Controls, Inc. is believed to be the only responsible source with a DSS TOP SECRET facility clearance which is capable of providing certified maintenance technicians with DSS TOP SECRET security clearances to perform these maintenance services. However, any Contractor with a DSS TOP SECRET facility clearance and DSS TOP SECRET cleared factory certified maintenance technicians capable of providing the required preventive and remedial maintenance services is asked to contact Phyllis Woodward via email at Phyllis.Woodward@fema.dhs.gov or by fax to 540-542-2631, no later than August 13, 2015. Please provide your company DUNS number and CAGE Code as well as your capability information. This information will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination not to compete this proposed procurement based on responses to this notice is solely within the discretion of the Government.
