- The Bureau of Indian Affairs (BIA) is soliciting offers to procure for materials for the Division of Transportation, Force Accounts Farmington, NM. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. Solicitation No. A15PS00921, herein cited is issued as a Request for Quote (RFQ) and will be procured under FAR Part 12, Acquisition of Commercial Items. Solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-81. Set aside for Small Business. The NAICS Code is 423390, Size standards 100. Contractor shall provide all labor, materials, supervision, incidentals and deliver to the project following material to a road construction project located in Cottonwood, Arizona.1) Sikadur 42 Grout Pak 3 gallon kit and Epoxy A/B resen C Bag 0.5 cubic feet with adequate material to cover 405 Cubic Feet. See attached product Data Sheet for information on Sikadur 42, grout-Pak. All materials shall meet the requirements of the Standard Specifications for construction of roads and bridges on Federal Highway Projects FP-03 Section 720.02, gabions and revet Mattress Material. Certificates of Compliance shall be submitted to the Construction Manager who will schedule installation dates and quantities. Please provide a complete breakdown of your price. Include all applicable taxes. VARIATION IN QUANTITY CLAUSE (Apr 1984) (a) a variation in the quantity of any item called for by this contract will not be accepted unless the variation has been caused by conditions of loading, shipping or packing or allowances in manufacturing processes and then only to the extent, if any, specified in paragraph (b) of this clause. (b) The permissible variation shall be limited to: 20% increase, 20% decrease. This increase or decrease shall apply to all line items in the contract. Period of Performance is from date of award through September 30, 2016. Award will be made at a fair and reasonable price to the responsive and responsible offeror whose quote conforming to the requirements herein will be the most advantageous to the Government, price and other factors considered. CONTRACT CLAUSES: The following clauses apply to this acquisition: FAR 52.212-1, Instructions to Offerors Commercial Items; FAR 52.212-3, Offeror Representations and Certifications Commercial Items; FAR 52.212-4, Contract Terms and Conditions Commercial Items; and FAR 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders Commercial Items. In paragraph (b) of FAR 52.212-5(b), the Contractor shall comply with the following FAR clauses that the Contracting Officer has indicated as being incorporated in this contract by reference to implement provisions of law or Executive order applicable to acquisitions of commercial items: FAR 52.223-18, Encouraging Contractor Policies to Ban Text Messaging while Driving; FAR 52.225-1 Buy American Act-Supplies; FAR 52.222-3, Convict Labor; FAR 52.211-16, Variation in Quantity; FAR 52.211-17, Delivery of Excess Quantities; FAR 52.232-18, Availability of Funds; FAR 52.216-02, Economic Price Adjustment-Standard Supplies: The Service Contract Act does apply and DIAR clauses are herein incorporated as follows:. 1452.226-70, Indian Preference; 1452.226-71, Indian Preference Program; 1452.280-4, Indian Economic Enterprise Representation; and 1452.204-70, 52.232-99, Providing Accelerated Payment to Small Business Subcontractors. Award will be made at a fair and reasonable price to the lowest responsive and responsible offeror whose quote conforming to the requirements herein will be the most advantageous to the Government.
