Description

Brand Name Justification JUSTIFICATION 1. AGENCY AND CONTRACTING ACTIVITY: The Enterprise Information Technology Services Directorate (EITSD), in conjunction with Washington Headquarters Services/Acquisition Directorate (WHS/AD), proposes to procure brand name items in accordance with the Commercial Items Test Program of Federal Acquisition Regulation (FAR) subpart 13.5. 2. NATURE/DESCRIPTION OF ACTION(S): This will be a new, firm-fixed price action for NOMAD, NAPA, Collection, and UltraQuest products by Select Business Solutions, Inc. The Government intends to procure the subject supplies using commercial items test procedures, per FAR 13.5. 3. DESCRIPTION OF SUPPLIES/SERVICES: The Government intends to renew annual software maintenance for Enterprise Information Technology Services Directorate (EITSD) Washington Headquarters Services Allotment System (WAAS) and Total Force Administration System (TFAS). Select Business Solutions, Inc, 200 E. 7th Street, Suite 414, Love-land, CO 80537-4871 is the sole and propriety vendor under Software License Agreement (SLA) cus-tomer number: AR011928 and account #: 81P388. The total contract award value is $150,921.00. Select Business Solutions, Inc will provide the following products NOMAD, NAPA, Collection, and UltraQuest to support the WASS AND TFAS systems. This will provide end user reporting, data extraction and anal-ysis. The specific models are as follows: • NOMAD Maintenance, MFR PART NR: NM-NOMD-MFVH-RE • NOMAD Collection Maintenance, MFR PART NR: NM-COLL-MFVH-RE • NOMAD NAPA Maintenance, MFR PART NR: NM-NAPA-MFVH-RE • UltraQuest Maintenance, MFR PART NR: NM-UQFS-CFMH-RE • NOMAD & UQ Backup License Maintenance, MFR PART NR: NM-UQCH-CFMH-RE • UltraQuest Charts Maintenance, MFR PART NR: NM-OTHR-MFVW-RE 4. IDENTIFICATION OF STATUTORY AUTHORITY: FAR 13.501(a) (1) (ii) Acquisition under the authority of the test program for commercial items at 41 U.S.C. 1901. The total DEPARTMENT OF DEFENSE WASHINGTON HEADQUARTERS SERVICES 1155 DEFENSE PENTAGON WASHINGTON, DC 20301-1155 Acquisition Directorate amount of the award exceeds $150,000, but does not exceed $650,000. Therefore, no formal justification per FAR Part 6 is required. 5. DEMONSTRATION OF CONTRACTOR'S UNIQUE QUALIFICATIONS: Select Business Solutions Inc. is the sole and proprietary vendor of listed products (NOMAD, NAPA, Collection, and UltraQuest). No other vendors offer supports, or maintain these products. This soft-ware is used for the WAAS and TFAS systems. The particular brand name, product, or feature is es-sential to the Government's requirements, and market research indicates other companies' similar products or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency's needs. The SBS manufacturer has proprietary data rights that effectively preclude competing annual maintenance for products. EITSD/WHS provides accounting support to specified DoD organizations, and system support for the WHS Allotment Accounting System (WAAS), an accounting system used for a majority of the individual organizations and funds. WHS maintains the official accounting records for funds that it receives, and also provides accounting support to various funds allocated to the Office of the Secre-tary of Defense, the United States Court of Appeals for the Armed Forces, the Pentagon Reservation Maintenance Revolving Fund and the Pentagon Building Maintenance Fund. As part of the overall quality control process, WHS personnel are required to prepare trial balances on a quarterly basis to identify deficiencies when they occur and correct those deficiencies before preparing the year-end fi-nancial statements. WHS uses the WAAS to perform general ledger accounting. The WAAS is an au-tomated, transaction-driven accounting system using DoD standard general ledger accounts. The WAAS is also able to produce trial balances by fiscal year and by appropriation. However, the WAAS is a DoD legacy system, which will be replaced in late 2015. 6. DETERMINATION OF FAIR AND REASONABLE COST: The Contracting Officer will ensure that the resulting contract award cost/price is fair and reasonable per FAR 13.106-3(b)(vi), by comparing the contractor's proposal to the independent government cost estimate, by reviewing historical pricing, and comparing proposed labor rates to those established (and under similar contracts for like services and labor categories). 7. DESCRIPTION OF MARKET RESEARCH: On December 12, 2014, the Government posted a Special Notice (Notice of intent to Sole Source) on FedBizOpps to determine capable sources for this requirement. This notice closed on December 17, 2015 with no responses to the Special Notice. 8. ANY OTHER SUPPORTING FACTS: Select Business Solutions Inc. is the sole and proprietary vendor of listed products (NOMAD, NAPA, Collection, and UltraQuest). No other vendors offer supports, or maintain these products. 9. LISTING OF INTERESTED SOURCES: N/A 10. ACTIONS TAKEN TO REMOVE BARRIERS TO COMPETITION: The Government will compete all future acquisitions as brand-name or equal.
