- SOW/NYS INDUSTRIAL CODE RULE SECTION 56-5.1 SOLICITATION The Contractor shall provide all construction services to remove the materials that have been found to have asbestos in them and replace materials in areas as needed. A separate air monitoring contractor will need to perform testing. Asbestos will be removed and disposed of according to State and Federal Regulations and disposal logs will be vetted through 109th Environmental. All necessary State and Federal notifications will be managed by the contractor and submitted for review to the 109 AW Environmental office prior to submittal to corresponding regulatory agency. Any associated filing and permitting fees will also be paid for by the contractor. Disposal location must be approved by 109 AW prior to removal, and all disposal paperwork must be coordinated through the 109 AW environmental office. THIS REQUIREMENT IS FOR AIR MONITORING ONLY.
