- .Justification ancl Approyal (J&Al I. Defense Logistics Agency (DLA) Troop Support, Hardware Supply Chain, is the contracting activity. 2. The action being approved is the ability to solicit for DLA requirements on other than a full and open competition basis. 3. Following are the supplies required to meet DLA's needs: National Stock Number (NSN)/Item Description: 5330-00-606-8780/Seal, Special, Eaton Aerospace LLC Part Number 138488 Quantity: 515 EA Unit Price: $380.56 Estimated Dollar Value: $195,988.40 4. The applicable statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)( l), FAR Part 6.302-1, only one responsible source, and no other type of supplies will satisfy the agency requirement. 5. NSN 5330-00-606-8780 is a Seal, Special that is used on a Motor, Hydraulic and Pump, Axial Piston on an Aircraft, Stratolifter C/CK-135 (05F). Original Equipment Manufacturer (OEM) Eaton Aerospace LLC.is the only acceptable source of supply for the Seal, Special. The Government does not possess technical data to procure this item competitively. The AMC/AMSC is 3 P indicating that the item is sole source and the technical data is proprietary. 6. The acquisition will be synopsized to ensure that offers are solicited from as many sources as practicable. In addition, this justificati9 11 will be synopsized in accordance with FAR 6.305(c). In an effort to identify other potential suppliers, an RPI/Sources Sought notice was issued in FedBizOps, but no response was received. 7. As the contracting officer, I hereby determine that the anticipated cost to the Government will be fair and reasonable, based on the evaluation of information other than ce1tified cost or pricing data • and by comparison to previous prices paid. 8. Market research was conducted via a survey and discussions with the OEM, Eaton Aerospace. A review of Eaton's website was also completed and Haystacks was referenced for contract history. Eaton will quote directly.on this requirement, with an estimated lead time of 610 days. Eaton considers this a commercial item and it is listed in their spare patts price book. 9. Technical data is not available and cannot be developed to permit full and open competition. The data presently available reflects the minimum needs of the Government. 10. Sources expressing an interest in the acquisition include Eaton Aerospace LLC. 11. In an effort to overcome barriers to competition, an RPI/Sources Sought notice was issued in FedBizOps for the purpose of finding potential manufacturers. No responses were received. The solicitation for this item will contain the provision DLAD 52.217-9002 titled Conditions for Evaluation and Acceptance of Offers for Part Numbers Items, which contains instructions for submission of an alternate offer.
