Description
Award of Symantec NetBackup Platform Capacity Based Software Licenses and Support: On September 26, 2014, the Technology Acquisition Center awarded delivery order VA118-14-F-0584 to Affigent, LLC in the amount of $6,491,009.36. This delivery order was issued under National Aeronautics and Space Administration Solutions for Enterprise-Wide Procurement IV Government-Wide Acquisition Contract NNG07DA19B. This order provides for Symantec NetBackup Platform capacity based software licenses and support to backup all Enterprise Operations hosted systems, storage, and associated applications that are currently deployed for backup and restore at all Enterprise Operations primary and satellite datacenter locations. Delivery of the licenses is required within 30-days after receipt of order, with a period of performance of 12-months from date of delivery. Funds in the amount of $6,491,009.36 were obligated to fully fund the delivery order. The customer is Service Delivery and Engineering, Enterprise Operations. JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY 1. Contracting Activity:Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 23 Christopher Way Eatontown, NJ 07724 2. Description of Action: This proposed action is for a firm-fixed price (FFP) delivery order issued under the National Aeronautics Space Administration (NASA) Solutions for Enterprise Wide Procurement (SEWP) IV Government Wide Acquisition Contract (GWAC) for Symantec NetBackup Platform Capacity based software licenses and support. The Office of Information and Technology, Service Delivery and Engineering, Enterprise Operations (EO) office, requires the purchase of the Symantec NetBackup Platform Base Complete Edition 7.6 Platform 1 Front End Terabyte (TB) License for VA's Enterprise Backup (EBU) Solution, as well as support to include remote product assistance and training. The Symantec NetBackup Platform Base solution will replace the existing Symantec NetBackup Standard Client Server licenses previously purchased through VA's Data Center Acquisition (DCAT4) contract. Delivery of the licenses is required within thirty (30) days after receipt of order, with a period of performance of 12 months from date of delivery for annual maintenance support and training. 3. Description of the Supplies or Services: The mission of EO is to provide high quality, cost-effective information technology (IT) business solutions to VA and other federal agency customers. EO has been a major data center in VA's system for over 40-years and is committed to supporting VA's IT requirements. EO provides data protection services to its customers' data through disk mirroring and tape backups. Routine evaluation of the tape and storage environment is required to ensure data protection and disaster recovery resources are available to the customer in a timely manner. The proposed action is to procure Symantec NetBackup software licenses to support 1,001 TBs of storage for EO systems located at the following primary datacenters and satellite locations, including but not limited to: Austin Information Technology Center, Philadelphia Information Technology Center, Hines Information Technology Center, Central Region Recovery Center, Quantico Information Technology Center, and Culpepper Information Technology Center. This software will support backups for all EO hosted systems, storage, and associated applications that are currently deployed for backup and restore at all EO primary and satellite datacenter locations. The annual maintenance support includes patches, bug fixes, new features, and new product releases. Training shall be for the 10 EBU team members, 29 database administrators, and other administrators. The total estimated price of this proposed action is $. 4. Statutory Authority: The statutory authority permitting an exception to fair opportunity is Section 41 U.S.C. 4106(c)(2) as implemented by the Federal Acquisition Regulation (FAR) Subpart 16.505(b)(2)(i)(B), entitled "Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized". 5. Rationale Supporting Use of Authority Cited Above: This is a brand name justification in support of FAR 11.105, Items Peculiar to One Manufacturer. Symantec's suite of NetBackup product licenses and maintenance support provides a unique solution that is the only product compatible and interoperable with the existing EO backup solution. Using an alternative licensed solution would compromise the integrity of the protected systems across all EO locations. Any solution other than Symantec NetBackup would require purchasing additional acquisition infrastructure and engineering services to integrate the new software onto the current systems deployed across EO, all of which could take upwards of 36 months to complete. Migrating off Symantec NetBackup and onto a new product would also require continued maintenance support of NetBackup licensing until the migration is completed to ensure all 70,000 currently vaulted encrypted tapes, including litigation tapes residing in an off-site vault, could be accessed on-demand. Without continued maintenance support during a migration to a new product, the Government could not recover data residing on any of the tapes created within the NetBackup proprietary database, nor would the Government be able to locate a particular tape in the NetBackup catalog. Additionally, should a new solution be considered, the costs incurred for purchasing additional acquisition infrastructure and engineering services, and continuing maintenance support of the NetBackup licensing until the migration is completed, are not expected to be recovered through competition. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. This effort did not yield any additional sources that can meet the Government's requirements. It was determined from NASA SEWP IV Manufacturer Lookup Tool that limited competition is viable among 17 authorized resellers for this brand name item from Symantec. In accordance with FAR 5.301 and 16.505(b)(2), this action will be synopsized at award on the Federal Business Opportunities Page (FBO) and the justification will be made publicly available. 7. Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are changes in the market place that would enable future actions to be competed. 8. Market Research: The Government's technical experts conducted market research by reviewing other similar software. This market research is an ongoing process that is continuously being conducted, as recently as March 2014. The other similar software products reviewed included EMC Networker, and International Business Machines (IBM) Tivoli Storage Manager. Based on reviews of these products, the Government's technical experts determined that none of these products can meet the Government's interoperability and compatibility requirements in regard to the existing EO backup solution, for the reasons discussed above. Additionally, VA networking Subject Matter Experts regularly review industry trade publications and conduct internet research to ascertain if any other brand name software is available. Based on all of these market research efforts, the Government's technical experts have determined that only Symantec brand name software can meet all of VA's needs. 9. Other Facts: The current license agreement for the NetBackup suite of products expires September 30, 2014. Should the current license agreement expire without procurement of the aforementioned new licenses for NetBackup Platform Base solution, the Government would not be able to recover data residing on any of the encrypted tapes created within the NetBackup proprietary database, nor would the Government be able to locate a particular tape in the NetBackup catalog.
