Description
DETERMINATION AND FINDINGS PROCUREMENT BELOW THE SIMPLIFIED ACQUISTION THRESHOLD Upon the basis of the following findings and determination, the Contracting Officer has determined the proposed action is for an amount not to exceed the simplified acquisition threshold and the circumstances of the contract action deem only one source reasonable available to provide Raytheon Trusted Computer Solutions (RTCS) Trusted Thin Client (TTC) licenses and maintenance. FINDINGS 1.Contracting Activity: The Headquarters US Army Intelligence and Security Command (INSCOM) is the procuring activity for this action. 2.Description of the Supply or Service Purchased: The 513th MI BDE requires the renewal of their Raytheon Trusted Computer Solutions (RTCS) Trusted Thin Client (TTC). TTC is a Defense Information Agency (DIA) accredited Commercial-Off-The-Shelf (COTS) solution that provides users with secure simultaneous access to information on any number of different networks through a single connection point. TTC provides end users access to all allowable networks from a single device. TTC maintains secure data separation while allowing users appropriate access to networks at different classification levels in an organization. TTC must be used per the Raytheon Trusted Computing Solutions (RTCS) Defense Information Agency (DIA) Approved Products List (12 Dec 2012) for use with the DIA-accredited Trusted Thin Client. Any change to the architectural baseline requires an approved Engineering Change Proposal (ECP) and would result in significant security certification and accreditation issues. The equipment has passed rigorous national security certification and accreditation to support inter-communication between software and networks operating at single or multiple classification levels. 3.Dollar Amount: The estimated cost of the proposed action is $55,538.00. The type of funds is O&M. Purchase Request # W81GNN4171N133. 4.Authority Cited: FAR 8.405-6(a)(1), quote mark Limiting Sources quote mark 5.Reason for Authority Cited: The required subscription is for Raytheon Trusted Computer Solutions TTC license and maintenance. The license and maintenance can only be provided by Raytheon Trusted Computer Solutions who is the proprietary developer of the Trusted Thin Client software. 6.Market Research: Market research was conducted utilizing government and commercial databases for pertinent information and contacting the software developer. Army CHESS: Market research was conducted by reviewing the Army mandated CHESS website. In accordance with the CHESS Memorandum, the Department of the Army is to use the Computer Hardware, Enterprise Software and Solutions (CHESS) as the primary source for procuring commercial information technology hardware and software (AFARS 5139.101). Market Research provided that the CHESS contractor community is not capable of providing the requirement through the Army CHESS Program. A statement of non-availability (#216687241) is required in response to the CHESS inquiry. Market research conducted by INSCOM DCGS-A (Fixed) Engineering Staff verified that TTC licenses and maintenance support were able through the through the GSA Schedule#: GS-35F-0084J to satisfy INSCOM's requirements. DETERMINATION Contracting Officer Certification: Based upon the above findings, I have determined that the proposed action is justified under FAR 8.405-6(a)(1), the Contracting Officer hereby determines that the circumstances of the contract action deem only one source is reasonably available.
