Description
LIMITED SOURCE JUSTIFICATION AND APPROVAL Upon the basis of the following justification, I, as the Contracting Officer, hereby approve issuance of the contractual action described herein based upon the statutory exception(s) to the fair opportunity process pursuant to the authority of the Multiple Award Schedule (MAS) Program (Title 40 USC 501, Services for Executive Agencies) and in accordance with Federal Acquisition Regulation (FAR) FAR 8.405-6 Limited Sources Justification and Approval, FAR 16.505(b)(2)(iii), and the Department of Defense (DoD) Far Supplement (DFARS) 208.405-70(b)(2) and Procedures, Guidance and Information (PGI) 216.505-70(2)(i)(B). 1. Identification of Agency and Contracting Activity The Regional Contracting Office, National Capital Region (RCO-NCR), located at 2010 Henderson Road, Marine Corps Base (MCB), Quantico, Virginia 22134 will acquire the required services described herein on behalf of Marine Corps Combat Development Command (MCCDC), Operations Analysis Division (OAD), 3300 Russell Road, Marine Corps Base, Quantico, VA 22134. 2. Nature/Description of Action Being Approved This justification is to seek approval to issue a sole source task order to Northrop Grumman Corporation under the MOBIS contract vehicle, GSA contract number GS-23F-8079H, for the Marine Corps Study System Program Assessment (MCSSPA) Follow-On. 3. Description of Supplies/Services The Northrop Grumman Study Team will recommend changes to Marine Corps Study Information System (MCSIS) needed to replicate the Branch Head and Director functionality currently contained in Enhanced Knowledge Awareness Database (eKad). The Study Team will also identify any Microsoft (MS) Access objects (e.g., forms, tables, queries, modules, etc.) that would need to be created to incorporate eKad's Branch Head and Director functionality into MCSIS. The Study Team will recommend possible designs of new MS Access objects to the Government for review. The Study Team will present all recommendations in the form of a prototype. The prototype, along with an MS PowerPoint presentation describing the prototype functionality, will be delivered to the Government for their review. The Study Team will also present the prototype design to the Government within the context of an In-Progress Review (IPR) and the Government will provide comments on the prototype. The Study Team will identify any changes that need to be made to the MCSIS User Manual and Maintainer Manual with regard to the Study Team-proposed recommendations. At the conclusion of the study, the Study Team will provide a briefing and a prototype demonstration, reviewing all of the recommended changes. The briefing and prototype demonstration will be given up to a maximum of seven times (once for each branch in OAD and once for the Director, Deputy Director, and Technical Director). The period of performance shall be for six (6) months from the date of task order award. The requirement will be a Firm Fixed Price (FFP) task order under a GSA contract with an estimated value of <redacted - value is less than $500,000.00>. 4. Identification of Justification Rationale Northrop Grumman was the original developer of MCSIS in 2010. Since the inception of MCSIS, Northrop Grumman has accomplished three major phases in the development of MCSIS, including the initial phase of MCSSPA. This requirement is the fourth and final phase to complete MCSIS, the follow-on phase to MCSSPA. Northrop Grumman had gained an expertise in the MCSIS arena that would be difficult for another contractor to duplicate without an excessive expenditure of time and labor. Northrop Grumman developed the original MCSIS tool and has since been able to absorb numerous databases also used by OAD in order to control the flow of data and reduce the number of errors received by users requiring data in order to accomplish numerous studies assigned throughout the year. 5. Determination of Fair and Reasonable Cost Pursuant to FAR 8.404(d), by placing an order against a GSA FSS contract using the procedures in FAR 8.405, the ordering activity has concluded that the order represents the best value and results in the lowest overall cost alternative to meet the Government's needs. In addition, GSA has already determined the prices and rates under the FSS contract to be fair and reasonable. The Contracting Officer will ensure that all pricing is at or below the established GSA pricing and may seek additional discounts before placing an order. Therefore, it is the Contracting Officer's determination that the anticipated cost to the government will be fair and reasonable and that the order represents the best value consistent with FAR 8.404(d). 6. Description of Market Research No offer will be solicited from other sources for the reasons described herein. Notices required in FAR Part 5 are not required for FAR 8.6 procurements. Due to specialized/unique and extensive experience by Northrop Grumman no other company can reasonably complete the efforts required without extensive duplication of effort and unacceptable delays to the Government. As such, a formal market survey among schedule holders was not conducted; however a review of the Northrop Grumman Federal Supply Schedule (FSS) contract number GS-23F-8079H was conducted, which identifies the competitive pricing of required services from Northrop Grumman. 7. Other Factors Supporting the Justification Award to any other source would result in a substantial duplication of cost to the Government that is not expected to be recouped through competition, and unacceptable delays in fulfilling the agency's requirement. Northrop Grumman would be required to continue services while another contractor became proficient enough to provide the required services. In accordance with FAR 8.405-6(1)(B) only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized. 8. Actions Taken to Remove/Overcome Barriers to Meeting the Requriements of FAR 8.405-2 Operations and Analysis Division (OAD) is currently working on a full and open competitive contract for future studies and analysis tasking in the form of the Research and Innovative Technical Analysis (RITA) Professional Services acquisition, which is currently in source selection phase and expected to be active in early FY15. This task order will ensure that the critical services required under MCSSPA continue until the competitive contract is awarded.
