Description
The Naval Air Systems Command (NAVAIR), Patuxent River, MD intends to negotiate and award a sole source, Firm Fixed Price (FFP), Delivery Order under Basic Ordering Agreement (BOA) N00019-12-G-0008 with Insitu Inc., 118 E. Columbia River Way, Bingen WA, for launch and recovery equipment (LRE), related technical information, and operation center (i.e., call in) technical support for the previously procured Scan Eagle unmanned air systems for the Lithuania Ministry of Defense. The estimated total value of the contract action is $600K and will be funded with Section 1206 Foreign Military Sales (FMS) funds. (FMS Case J1-P-LAP). Insitu, the Original Equipment Manufacturer (OEM), as the sole designer and manufacturer is the only available source for the ScanEagle system and sustainment parts. The ScanEagle UAS was procured as a Commercial Off the Shelf (COTS) derivative product and no drawings, data or technical information were obtained as part of the procurement. Insitu fully funded the development of the ScanEagle and retains full ownership and proprietary rights to all technical data. The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under authority of FAR 6.302. Interested persons may identify their interest and capability to respond to the requirement or submit proposals. The authority permitting other than full and open competition is Title 10 U.S.C. 2304(c)(1) and FAR 6.302-1, "Only One Responsible Source and No Other Type of Supplies or Services will Satisfy Agency Requirements." Unless otherwise stated herein, no formal request for proposal or additional written information is currently available. Request for same will be disregarded. A determination by the Government not to compete is solely within the discretion of the Government. This synopsis is published for information purposes only (THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS). There are no commitments by the government to issue any solicitations, make an award or awards, or to be responsible for any monies expended by any interested parties before award of a contract modification for the efforts mentioned above. Information provided herein is subject to change and in no way binds the Government to solicit for or award a contract. No telephone responses will be accepted. Numbered Note 22 applies.
