Attachment 2: Request for Sole Source Memo DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Organization: Department of Veterans Affairs, VISN 08, James A Haley VA Medical Center (JAHVAMC), 13000 Bruce B. Downs Blvd. Tampa, FL 33612, - Justification for Other Than Full and Open Competition. Requisition Number: 673-14-4-046-0746 2.Nature and/or Description of the Action Being Processed: This is a one-time request for Other Than Full and Open Competition for the procurement service of materials/parts to repair one 1188 HD Camera system from Stryker Endoscopy, 5900 Optical Ct., San Jose, Ca. 95138, to first class operating condition. 3.Description of Supplies or Services: There is an extremely urgent need for the repair of a Stryker Endoscopic Camera System. This system is inoperative as it does not recognizing the camera heads when connected to the device. This unit is used for daily surgical procedures performed at JAHVAMC. Delay in repair will result in cancellation of surgical procedures or the need to outsource scheduled surgeries to a third party on a fee basis. In-house staff does not have the specialized test equipment and parts required to perform this critical level of service. This repair encompasses bringing the system back to full manufactures specifications for use. 4.Statutory Authority Permitting Other than Full and Open Competition: (x ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability, or Expert Services; ( ) (4) International Agreement ( ) (5) Authorized or Required by Statute; ( ) (6) National Security; or ( ) (7) Public Interest 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): This unit was manufactured by Stryker with specifically engineered parts. Accordingly, Stryker Endoscopy is the only firm capable of providing the supplies and services described in Section III above without JAHVAMC experiencing substantial duplication of cost that could not be expected to be recovered through competition and unacceptable delays in fulfilling its requirements to perform surgical procedures. As this unit is used in surgery on a daily basis; delay of repair by having to source parts will cause rescheduling or cancellation of needed surgical operation. 6.Actions to Promote Competition: We are required to limit the use of sole source contract by measures within the Contracting field to bring on new sources and implement planning to preclude urgent requirements from arising. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: This is for an initial estimated repair not to exceed (NTE) the initial planned funding of $4,195.00. ALL repairs are NTE agreed upon Firm-Fixed-Price without additional approval and modification of this order by an authorized and warranted Contracting Officer. The contractor (Stryker Endoscopy) will, after initial consultation provide the contracting officer in writing the actual anticipated cost of repairing each system before the commencement of any work performed. Price reasonableness will be determined based on established catalog/market prices for the maintenance, calibration or repair of equipment. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: This is a one of a kind device not manufactured by any other company; all other repair sources would rely on parts from manufacture. It is our policy to seek full and open competition to the largest extent possible while fulfilling the necessary requirements. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: A statement of work has been developed for this procurement (firm-fixed-price repair), but the critical need for these repair services is time-sensitive and delays can have an adverse impact on patient care, a hot button issue with Veterans Health Administration. 10.Listing of Sources that expressed, in writing, an interest in the acquisition: See Section VI above. 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: It is our policy to seek full and open competition to the largest extent possible while fulfilling the necessary requirements.
