Description
Amendment 0009 1. Item #5 from Amendment 0007, ("The Government hereby informs all interested firms/offerors") is hereby deleted in its entirety as it is an administrative error. 2. Addendum to FAR 52.212-1: The Government is requesting one offer from all firms for the fabrication of the containers as specified in the Request For Quotations, (inclusive of drawings, specifications, and amendments), and as seen at the site visit. Additionallly the Government is also interested in receiving and evaluating multiple offers in accordance with FAR 52.212-1. Multiple offers shall be for: (1) separate itemized costs for the air compressor and grinder; (2) a container with any innovations that will improve the containers functionality. Improvements in functionality include, but is not limited to the following: air inlet needs to have a quick disconcert, better door design that does not stick out when putting the 2 containers together, keeping only one of the lockers and replacing the rest with Brand Name Vidmar (or equal) type cabinets on the other side. Multiple offers will be evaluated for award in accordance with FAR 52.212-1(e). Past Performance is an evaluation factor and all past performance information for recent and relevant contracts is to be provided in accordance with FAR 52.212-1(b)(10). 3. FAR 52.212-2 is hereby corrected to read that the Government will award to the Lowest Priced Technically Acceptable Offer from a Responsible firm with an Acceptable Past Performance record. FAR 52.212-2 is also amended to state that the Government reserves the right to make an award on an offer to fabricate containers per the specifications and drawings contained in the Request For Quotation or an offer that contains additional functionality innovations or improvements. 4. The unit price for all containers is to include the pricing for CSC testing/certification. 5. The date and time established for receipt of offers, 0800 (Eastern USA Time) on 24 July 2014, remains unchanged. 52.212-2 Evaluation-Commercial Items. Evaluation-Commercial Items (Jan 1999) (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: Lowest Priced Technically Acceptable Offer from a Responsible firm with an Acceptable Past Performance record. The Government reserves the right to make an award on an offer to fabricate containers per the specifications and drawings contained in the Request For Quotation or an offer that contains additional functionality innovations or improvements. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
